Hutt County Council required under Town Planning Act, 1926,
to prepare and submit to the Town-planning Board an
Extra-urban Planning Scheme.

GALWAY, Governor-General.
ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 16th day
of January, 1941.

Present :
THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL.

WHEREAS the Hutt County Council is the responsible
authority within the meaning of the Town Planning
Act, 1926, of a certain rural area as defined in the said Act—
namely, the Hutt County :

And whereas His Excellency the Governor-General is of
opinion that settlement is taking place within a certain
defined area within the rural area aforesaid—namely, the
defined area described in the Schedule hereto—at such a
rate that the preparation of an extra-urban planning scheme
is deemed advisable in the public interest :

Now, therefore, in pursuance and exercise of the powers
conferred upon him by section twenty-five of the Town
Planning Act, 1926, His Excellency the Governor-General,
acting by and with the advice and consent of the Executive
Council, doth hereby require the Hutt County Council to
prepare and submit to the Town-planning Board before the
thirty-first day of December, one thousand nine hundred and
forty-one, an extra-urban planning scheme in respect of the
said area described in the Schedule hereto.

SCHEDULE.

ALL that area in the Wellington Land District situated in
Blocks XIV, XVI, and XVII, Belmont Survey District, and
bounded as follows: Commencing at a point on the north-
western corner of the area and more particularly at the
north-western corner of Section 16, Lowry Bay Registration
District, and thence along the north-eastern boundary of the
said Section 16 to the north-eastern corner of the said
Section 16, Lowry Bay Registration District; thence in a
straight line to the south-western corner of Lot 5, Deeds
Plan 136, and along the southern boundary of the said Lot 5
to the south-eastern corner of the said Lot 5, Deeds Plan 136 ;
thence in a straight line across Fitzherbert Road to the north-
western corner of Lot 23, Deeds Plan 136, and along the
northern boundary to the north-eastern corner of the said
Lot 23, Deeds Plan 136; thence continuously along the
south-eastern boundaries of Lots 23, 24, 25, and 26, Deeds
Plan 136, to the most easterly point on Lot 26, Deeds Plan 136 ;
thence along the south-eastern boundaries of Lots 26 and 27,
Deeds Plan 136, to the south-eastern corner of the said Lot 27,
Deeds Plan 136; thence continuously along the western
boundary of Section 85, Block XVII, Belmont Survey District,
to the south-western corner of the said Section 85, Block XVII,
Belmont Survey District; thence by a straight line to the
point where the eastern boundary of the land in D.P. 9490
cuts Moore's Valley Road and thence continuously in the same
line until that line meets the northern side of the Wainui-o-
mata River; thence in a south-westerly direction along the
northern bank of the Wainui-o-mata River until the said
bank meets the western boundary of Block XVII, Belmont
Survey District; thence in a southerly direction along the
western boundary of Block XVII, Belmont Survey District,
to a point which is the continuation of the most southern
boundary of the land in C.T. 381/220 in an easterly direction
until it meets the said western boundary of Block XVII,
Belmont Survey District; thence in a straight line from the
said point on the western boundary of Block XVII, Belmont
Survey District, to the most southerly corner of the land
in C.T. 381/220 and along the south-western boundary of
the said land in C.T. 381/220 to a point where the said
boundary intercepts the south-eastern boundary of Section 39,
Wainui-o-mata Registration District; thence along the
south-eastern boundary of Section 39, Wainui-o-mata
Registration District, to the most easterly point of the said
Section 39, and thence along the north-eastern boundary to
the north-western corner of the said Section 39, and thence
along the north-western boundary to the south-western
corner of the said Section 39, Wainui-o-mata Registration
District; thence along the south-western boundary of Sec-
tion 41, Wainui-o-mata Registration District, to the most
westerly point on the said Section 41, Wainui-o-mata
Registration District; thence continuously in a north-westerly
direction along the eastern boundary of the Harbour Regis-
tration District until it meets the north-eastern boundary of

Section 16, Lowry Bay Registration District; thence along
the north-western boundary of Section 16, Lowry Bay
Registration District, to the point of commencement of the
area being the north-western corner of the said Section 16,
Lowry Bay Registration District.

Boundaries of City of Christchurch and County of Heathcote
altered.

GALWAY, Governor-General.
ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 16th day
of January, 1941.

Present :
THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL.

WHEREAS in pursuance of section one hundred and
thirty-six of the Municipal Corporations Act, 1933,
a petition was presented to the Governor-General praying
that a certain area of land be excluded from the County of
Heathcote and included in the City of Christchurch :

And whereas it is deemed expedient to make such alteration
of the boundaries of the said city :

Now, therefore, in pursuance and exercise of the powers
and authorities vested in him by the said Municipal Cor-
porations Act, 1933, and of all other powers and authorities
enabling him in that behalf, His Excellency the Governor-
General, acting by and with the advice and consent of the
Executive Council, doth hereby declare that as on and from
the first day of April, one thousand nine hundred and forty-
one, the area described in the Schedule hereto shall be excluded
from the County of Heathcote and included in the City of
Christchurch.

SCHEDULE.

AREA EXCLUDED FROM THE COUNTY OF HEATHCOTE AND
INCLUDED IN THE CITY OF CHRISTCHURCH.

ALL that area in the Canterbury Land District bounded by a
line commencing at a point on the north-eastern corner of
Lot 7, Deposited Plan 2607, being a point on the existing
boundary of the City of Christchurch; thence proceeding
generally southerly along the eastern boundaries of Lots 7,
6, 5, 4, 3, and part Lot 2, Deposited Plan 2607, and Lots 5
and 4, Deposited Plan 7837, to the north-eastern boundary
of Lot 2, Deposited Plan 7837, thence south-easterly along
that boundary and its production to a point on the south-
eastern side of Waimoni Road, the said point being on the
existing boundary of the City of Christchurch; thence south-
westcrly, northerly, and easterly along the said city boundary
to the point of commencement.

Setting-aside Native Land as a Native Reservation.

GALWAY, Governor-General.
ORDER IN COUNCIL.

At the Government House at Wellington, this 21st day of
January, 1941.

Present :
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

PURSUANT to section five of the Native Purposes Act,
1937, His Excellency the Governor-General, acting by
and with the advice and consent of the Executive Council,
doth hereby set apart and reserve the Native freehold land
described in the Schedule hereto as a Native reservation for
the common use of the Ngati Peehi and Ngati te Kanawa
tribes as a meeting-place, marae, kainga, fishing-ground, and
similar uses.
