Withdrawing Land from the Operation of the Kauri-gum Industry Act, 1908.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 30th day of April, 1941.

Present:

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL.

WHEREAS by section one hundred and sixty-two of the Land Act, 1924, it is enacted that the Governor-General may, by Order in Council, on the recommendation of the Land Board, declare that any land comprised in a kauri-gum reserve shall, from a date to be specified in the Order, cease to be subject to the Kauri-gum Industry Act, 1908, and on and after the date so specified the land to which the Order relates shall become subject to the provisions of the Land Act, 1924:

And whereas the Land Board of the North Auckland Land District has duly passed a resolution recommending that the portion of the Hohoura Kauri-gum Reserve Extension No. 2, as described in the Schedule hereto, be excepted from the operations of the Kauri-gum Industry Act, 1908, and it is expedient to give effect to such recommendation:

Now, therefore, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon me by section one hundred and sixty-two of the Land Act, 1924, and acting by and with the advice and consent of the Executive Council of the said Dominion, do hereby order and declare that the portion of the Hohoura Kauri-gum Reserve Extension No. 2, as described in the Schedule hereto, shall, from the fifteenth day of May, one thousand nine hundred and forty-one, cease to be subject to the Kauri-gum Industry Act, 1908.

SCHEDULE.

NORTH AUCKLAND LAND DISTRICT.

ALL that area in the Mangonui County, containing by admeasurement 5 acres 0 roods 32 perches, more or less, being part Hohoura Kauri-gum Reserve Extension No. 2, Block V, Hohoura East Survey District, as shown on S.O. plan 30671, deposited in the office of the Chief Surveyor at Auckland.

As the same is more particularly delineated on plan marked L. and S. 1/1035/1A, deposited in Head Office, Lands and Survey Department, at Wellington, and thereon edged red.

Officers authorized to take and receive Statutory Declarations.

PURSUANT to the authority conferred upon me by the three-hundred-and-first section of the Justices of the Peace Act, 1927, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, do hereby notify and declare that the persons whose names are set out in the Schedule hereto, being officers in the service of the Crown holding the offices stated opposite their names respectively in the said Schedule, are authorized to take and receive statutory declarations under the three-hundred-and-first section of the Justices of the Peace Act, 1927.

IN pursuance and exercise of the powers conferred by section thirteen of the Defence Amendment Act, 1912, I, Cyril Louis Norton Newall, the Governor-General of the Dominion of New Zealand, do hereby authorize the undermentioned officer to convene general or district courts martial for the trial under that Act of persons subject to military law, and empower such officer to confirm the findings and sentences of general or district courts martial, whether passed before or after the issue of this warrant:-

Lieutenant-Colonel Vincent Gordon Jervis, N.Z. Staff Corps, Deputy Adjutant-General, New Zealand Military Forces.

As witness the hand of His Excellency the Governor-General, this 24th day of April, 1941.

Vesting the Control of a Scenic Reserve in the Petone Borough Council.

IN pursuance and exercise of the powers and authorities conferred upon him by section thirteen of the Scenery Preservation Act, 1908 (hereinafter referred to as "the said Act"), His Excellency the Governor-General of the Dominion of New Zealand doth hereby vest the control of the scenic reserve described in the Schedule hereto (being land reserved under the said Act) in the Petone Borough Council, subject to the conditions hereinafter contained, that is to say:-

  1. The period for which the control of the reserve is hereby vested shall be ten years from the date hereof, unless the reservation is previously altered or revoked under the said Act.

  2. The said Council shall prepare a report each year ending on the thirty-first day of March, together with a statement of receipts and expenditure in connection with the said reserve. Such report and statement shall be sent to the Minister charged with the administration of the said Act as soon as possible after the close of the year.

  3. The said Council shall control the said reserve in accordance with the provisions of the said Act and of the regulations made thereunder.

SCHEDULE.

WELLINGTON LAND DISTRICT.

ALL that area containing by admeasurement 13 acres 3 roods 23Β·33 perches, more or less, being part Sections 4 and 5, Hutt Registration District, Block XIII, Belmont Survey District, and being all the land contained in Certificate of Title, Volume 451, folio 25, Wellington Registry.

As witness the hand of His Excellency the Governor-General, this 6th day of May, 1941.

IN pursuance and exercise of the powers and authorities conferred upon him by section thirteen of the Scenery Preservation Act, 1908 (hereinafter referred to as "the said Act"), His Excellency the Governor-General of the Dominion of New Zealand doth hereby vest the control of the scenic reserves described in the Schedule hereto (being land reserved under the said Act) in the Taihape Borough Council, subject to the conditions hereinafter contained, that is to say:-

  1. The period for which the control of the reserves is hereby vested shall be ten years from the date hereof, unless the reservation is previously altered or revoked under the said Act.
