Licensing A. E. Fuller and Sons to use and occupy a Part of
the Foreshore at Watering Bay, Bay of Islands, as a Site for
a Slip.

ORDER IN COUNCIL.

At the Government House at Wellington, this 9th day
of April, 1941.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

P URSUANT to the Harbours Act, 1923, His Excellency
the Governor-General, acting by and with the advice
and consent of the Executive Council, doth hereby license
and permit Alfred Ernest Fuller, Neville Leslie Fuller, and
William Norman Fuller, all of Russell, trading under the
style or title of A. E. Fuller and Sons (hereinafter called
“ the licensees,” which term shall include their successors
or assigns, unless the context requires a different construction),
to use and occupy a part of the foreshore and land below
low-water mark at Watering Bay, Bay of Islands, as shown on
plan marked M.D. 6261, approved on the 10th day of
January, 1927, and deposited in the office of the Marine
Department at Wellington, for the purpose of maintaining
thereon a slip, as shown on the said plan, such license to be
held and enjoyed by the licensees upon and subject to the
terms and conditions set forth in the Schedule hereto.

SCHEDULE.

(1) This license is subject to the Foreshore License Regulations 1940, and the provisions of those regulations shall,
so far as applicable, apply hereto.

(2) The term of the license shall be fourteen years from the
1st day of April, 1941.

(3) The premium payable by the licensees shall be one pound
(£1), and the annual sum so payable, two pounds (£2).

Licensing the Wilson’s (N.Z.) Portland Cement (Limited),
to use and occupy a Part of the Foreshore of Whangarei
Harbour as a Site for a Wharf.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

P URSUANT to the Harbours Act, 1923, His Excellency
the Governor-General, acting by and with the advice
and consent of the Executive Council, doth hereby license
and permit the Wilson’s (N.Z.) Portland Cement (Limited),
of Auckland (hereinafter called “ the company,” which term
shall include its successors or assigns, unless the context
requires a different construction), to use and occupy a part
of the foreshore and land below low-water mark in Whangarei
Harbour, as shown on approved plans marked M.D. 4164,
4615, 4633, 5095, and 7004, and deposited in the office of
the Marine Department at Wellington, for the purpose of
maintaining thereon a wharf, as shown on the said plans, such
license to be held and enjoyed by the company upon and
subject to the terms and conditions set forth in the Schedule
hereto :—

SCHEDULE.

(1) This license is subject to the Foreshore License Regulations 1940, and the provisions of those regulations shall,
so far as applicable, apply hereto.

(2) The term of the license shall be fourteen years from
the 1st day of April, 1941.

(3) The premium payable by the company shall be one
pound (£1), and the annual sum so payable, eight pounds (£8).

(4) The company shall grant to the public using the wharf
a general right-of-way connecting the wharf with the county
road fronting Section 113, Parish of Maungatapere.

(5) All persons, firms, or companies, with the exception
of Wilson’s (N.Z.) Portland Cement Company (Limited),
using the wharf shall pay shipping and goods wharfage
charges in accordance with the scale of charges prescribed
by the Whangarei Harbour Board’s by-laws for the time being
in force.

(6) The Master of every vessel discharging ballast at the
said wharf shall deposit such ballast above high-water mark,
or at such other place at may be approved by the Harbour-
master.

FOR the purposes of section six of the Visiting Forces
Act, 1939, and in accordance with the terms of sub-
section five of that section, I, Cyril Louis Norton Newall, the
Governor-General of the Dominion of New Zealand, do
hereby declare that the Air Forces of His Majesty raised in
New Zealand which are serving outside New Zealand during
or in respect of the present war shall be deemed to be serving
together and acting in combination with the Air Forces of
His Majesty raised in the United Kingdom.

As witness the hand of His Excellency the Governor-
General, this 10th day of April, 1941.

under Section 20 of the Land Laws Amendment Act, 1912,
or Section 161 of the Land Act, 1924.

IN pursuance and exercise of the powers and authorities
conferred upon me by section five of the Land Act,
1924, I, Cyril Louis Norton Newall, the Governor-General of
the Dominion of New Zealand, do hereby revoke the
Warrants specified in the first column of the Schedule
hereto setting apart the lands specified in the second column
of the said Schedule for disposal under section twenty of the
Land Laws Amendment Act, 1912, or section one hundred
and sixty-one of the Land Act, 1924.
