The South-eastern Side of Portion of Leek Street and the South-western Side of Portion of Railway Street, in the Borough of Newmarket, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 16th day of April, 1941.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Newmarket Borough Council on the fifth day of February, one thousand nine hundred and forty-one, viz. :
“ That the Newmarket Borough Council, being the local authority having control of the streets in the Borough of Newmarket, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to those portions of Railway Street and Leek Street, coloured red on plan P.W.D. 107976, adjoining part of Allotment 22, Section 4, Suburbs of Auckland, being land comprised in Certificate of Title, Vol. 531, folio 288, Auckland Registry ”;
the portion of streets affected by such resolution being described in the Schedule hereto, subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western side of the portion of Railway Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said street, or on the land shown as “Lot 2” on the plan referred to in the Schedule hereto fronting part of the portion of Leek Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said street.
SCHEDULE.
THE south-eastern side of all that portion of Leek Street, and the south-western side of all that portion of Railway Street, situated in the North Auckland Land District, Borough of Newmarket, fronting part Lot 25, of a subdivision of part Allotment 22, Section 4, Suburbs of Auckland. As the same are more particularly delineated on the plan marked P.W.D. 107976, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Consenting to Land being taken for the Purposes of the Iron and Steel Industry Act, 1937, in Block II, Waitapu Survey District.

IN pursuance and exercise of the powers and authorities conferred by the Public Works Act, 1928, the Iron and Steel Industry Act, 1937, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the land described in the Schedule hereto being taken for the establishment of iron and steel works and subsidiary undertakings.
