(2) In lieu of a rate of interest not exceeding four pounds (£4) per centum per annum, as specified in clause two of the said Order in Council, the rate of interest that may be paid in respect of the said loan shall be such as shall not produce to the lender a rate exceeding three pounds fourteen shillings (£3 14s.) per centum per annum.

(3) In lieu of repayment by equal aggregate annual or half-yearly instalments of principal and interest, as specified in clause three of the said Order in Council, the said loan shall be repaid as follows :—

(a) By fifty (50) equal payments of sixty-nine pounds six shillings and eightpence (£69 6s. 8d.), one of such payments to be made at the end of every half-year commencing from the date on which the said loan is raised. Each such half-yearly payment shall be applied firstly in payment of interest computed at the rate of three pounds fourteen shillings (£3 14s.) per centum per annum on the amount of the principal for the time being outstanding at the beginning of each such half-year, and the balance of such half-yearly payment in reduction of such principal.

(b) By a payment at the end of the twenty-fifth year from the date of the raising of the said loan of a sum equal to the amount to which the principal has been reduced in accordance with the preceding paragraph (a) hereof after payment of the aforementioned fifty (50) half-yearly payments.

Boundaries of Borough of New Plymouth and County of Taranaki altered.

ORDER IN COUNCIL.

At the Government House at Wellington, this 26th day of March, 1941.

Present:

His Excellency The Governor-General in Council.

WHEREAS in pursuance of section one hundred and thirty-six of the Municipal Corporations Act, 1933, a petition was presented to the Governor-General praying that a certain area of land be excluded from the County of Taranaki and included in the Borough of New Plymouth :

And whereas it is deemed expedient to make such alteration of the boundaries of the said borough :

Now, therefore, in pursuance and exercise of the powers and authorities vested in him by the said Municipal Corporations Act, 1933, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby declare that as on and from the first day of April, one thousand nine hundred and forty-one, the area described in the Schedule hereto shall be excluded from the County of Taranaki and included in the Borough of New Plymouth.

SCHEDULE.

AREA EXCLUDED FROM THE COUNTY OF TARANAKI AND INCLUDED IN THE BOROUGH OF NEW PLYMOUTH.

All that area in the Taranaki Land District bounded by a line commencing at the northernmost corner of Section 97, Fitzroy District ; thence north-easterly and easterly along the mean high-water mark of the sea and the left bank of the Waiwakaiho River to the north-eastern corner of Pukeweka No. 17A Block ; thence along the eastern boundary of the said Pukeweka No. 17A Block to its south-eastern corner; thence south-westerly generally along the south-eastern boundaries of the said Pukeweka No. 17A Block to its south-western corner ; thence by a right line to the south-eastern corner of Section 97, Fitzroy District ; thence north-westerly along the north-eastern boundary of Section 97 aforesaid to its northernmost corner, the point of commencement.

IN pursuance and exercise of the powers conferred by section forty-four of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-

General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

William Pritchard Spencer, Arthur Paul Stubblefield, Keith Reginald Harris, Arthur Edward McFadden, Walter Frank Heyder, Hubert George Wells, Harry Spencer, Henry McMillan, and Edmund Thomas Harvey

to be the Spencer Park Domain Board, having control of the land described in the Schedule hereto ; and doth hereby appoint Monday, the twenty-sixth day of May, one thousand nine hundred and forty-one, at eight o'clock p.m., as the time when, and the Spencerville Hall, as the place where, the first meeting of the Board shall be held.

SCHEDULE.

SPENCER PARK DOMAIN.

ALL that area in the Canterbury Land District, containing by admeasurement 20 acres 2 roods, more or less, and being part Reserve 1617, situated in Block IV, Christchurch Survey District, and bounded as follows : Towards the north-west by Heyders Road, 1055·23 links ; towards the north-east by a road reserved along the edge of a tidal lagoon, and again towards the east, south-east, and south-west by other part of Reserve 1617, 774·44 links, 1309·55 links, and 1500·0 links respectively. As the same is more particularly delineated on the plan marked L. and S. 1/964, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.
