The South-western Side of Portion of District Road, the North-eastern Side of Portion of Doon Road, and the Eastern Side of Forth Street, in the County of Peninsula, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 19th day of February, 1941.
Present:

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Administrator of the Government of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Peninsula County Council on the twenty-first day of November, one thousand nine hundred and forty, in so far as it affects the sides and portions of roads described in the Schedule hereto, viz.:

“ That the Peninsula County Council, being the local authority having control of the roads in the County of Peninsula, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to those portions of District Road and Doon Road abutting on Lots 14, 15, 16, 21, 22, 23, Block VIII, Township of Waverley, or to Forth Street abutting on Lots 14 and 23, Block VIII, Township of Waverley ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western side of the portion of District Road, the north-eastern side of the portion of Doon Road, and the eastern side of Forth Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portions of roads.

SCHEDULE.

THE south-western side of all that portion of road situated in the Otago Land District, County of Peninsula, known as District Road, fronting Lots 14, 15, and 16, Block VIII, D.P. 289, Township of Waverley.

Also the north-eastern side of all that portion of road situated in the said land district and county, fronting Lots 21, 22, and 23, Block VIII, D.P. 289, Township of Waverley.

Also the eastern side of Forth Street, in the said land district and county, fronting Lots 23 and 14, Block VIII, D.P. 289, Township of Waverley.

As the same are more particularly delineated on the plan marked P.W.D. 109650, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Authorizing the Laying-off of a Street off Wellington Road, in the City of Wellington, of a Width less than 66 ft., but not less than 40 ft., subject to Conditions as to the Building-line.

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL.

IN pursuance and exercise of the powers vested in him by the Municipal Corporations Act, 1933, and the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Administrator of the Government of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Wellington City Council to permit the laying-off of the proposed street described in the Schedule hereto of a width less than sixty-six feet, but not less than forty feet, subject to a condition that no building or part of a building shall at any time be erected on the land shown edged blue on the plan referred to in the said Schedule within a distance of twenty-five feet from the centre-line of the said street or on the land shown edged sepia on the said plan within a distance of thirty-five feet from the centre-line of the said street, or on the land shown edged green on the said plan within a distance of forty-eight feet from the centre-line of the said street.

SCHEDULE.

THAT proposed street, in the Wellington Land District, City of Wellington, containing by admeasurement 38·5 perches, more or less, being part Section 4, Evans Bay District, Block VII, Port Nicholson Survey District. As the same is more particularly delineated on the plan marked P.W.D. 109960, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Portion of Bedford Terrace, in the Borough of Waipukurau, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government House at Wellington, this 19th day of February, 1941.
Present:

HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Administrator of the Government of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waipukurau Borough Council on the sixteenth day of September, one thousand nine hundred and forty, viz.:

“ That the Waipukurau Borough Council hereby declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to Bedford Terrace, excepting that portion exempted by Order in Council No. 3227 published in Gazette 1928, page 352 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting either side of the portion of Bedford Terrace (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said street.

SCHEDULE.

ALL that street situated in the Hawke’s Bay Land District, Borough of Waipukurau, known as Bedford Terrace, extending from the Main South Road to Church Lane, excepting that portion of the said street referred to in the Order in Council dated 6th February, 1928, and published in the New Zealand Gazette 1928, page 352, and deposited in the Land Registry Office at Napier as No. 3227 (new). As the same is more particularly delineated on the plan marked P.W.D. 108814, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.
