The South-eastern Side of Portion of Ingoldsby Street, in the City of Christchurch, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 19th day of February, 1941.
Present:
HIS EXCELLENCY THE ADMINISTRATOR OF THE GOVERNMENT IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anywise enabling him in this behalf, His Excellency the Administrator of the Government of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Christchurch City Council on the seventeenth day of April, one thousand nine hundred and thirty-nine, viz.:
“The Christchurch City Council, being the local authority having control of the streets in the City of Christchurch, hereby by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of the south-east side of Ingoldsby Street adjoining the land contained in Certificate of Title, Volume 139, folio 61, being part Lots 1 and 2, part R.S. 71 ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of portion of Ingoldsby Street (described in the Schedule hereto), within a distance of forty-eight feet from the centre-line of the said portion of street.

SCHEDULE.
THE south-eastern side of all that portion of street situated in the Canterbury Land District, City of Christchurch, known as Ingoldsby Street, fronting part Lots 1 and 2, D.P. 731, being part Rural Section 71. As the same is more particularly delineated on the plan marked P.W.D. 105162, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The South-eastern Side of Portion of Plynlimon Road, in the County of Waimairi, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

“The Waimairi County Council, being the local authority having control of the roads in the County of Waimairi, by resolution dated the twenty-second day of January, one thousand nine hundred and
forty-one, declares that the provisions of section 128 of the Public Works Act, 1928, shall not apply to that portion of Plynlimon Road adjoining Lot 6, D.P. 703 ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Plynlimon Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.

SCHEDULE.
THE south-eastern side of all that portion of road situated in the Canterbury Land District, Waimairi County, known as Plynlimon Road, fronting Lot 6, D.P. 703, being part of Rural Section 242, Block XI, Christchurch Survey District. As the same is more particularly delineated on the plan marked P.W.D. 110327, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The South-eastern Side of Portion of Percy Street, the North-eastern Side of Portion of Whitney Street, and the North-western Side of Portion of Maxwell Road, in the Borough of Blenheim, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

“That the Blenheim Borough Council, being the local authority having control of the streets in the Borough of Blenheim, by resolution declares that the provisions of section 128 of the Public Works Act, 1928, shall not apply to the undermentioned portions of streets viz.:
“The south-eastern side of portion of Percy Street, the north-eastern side of portion of Whitney Street, and the north-western side of portion of Maxwell Road, fronting Lot 4 of Subdivision of Section 4, District of Omaka ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of portion of Percy Street, the north-eastern side of portion of Whitney Street, and the north-western side of portion of Maxwell Road (described in the Schedule hereto) within a distance of thirty-five feet from the centre-lines of the said portions of streets.

THE south-eastern side of all that portion of Percy Street, the north-eastern side of all that portion of Whitney Street, and the north-western side of all that portion of Maxwell Road, situated in the Marlborough Land District, Borough of Blenheim, fronting Lot 4 of Subdivision of Section 4, District of Omaka.
As the same are more particularly delineated on the plan marked P.W.D. 109594, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.
