The South-eastern Side of Portion of Lonsdale Street, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 10th day of December, 1941.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anyway enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the tenth day of November, one thousand nine hundred and forty-one, viz.:—
“That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-eastern side of the portion of Lonsdale Street adjoining Lot 14, D.P. 601, Block XI, Belleknowes Estate, such land being comprised and described in Certificate of Title, Register-book Volume 112, folio 81”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Lonsdale Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE.
The south-eastern side of all that portion of street situated in the Otago Land District, City of Dunedin, known as Lonsdale Street, fronting Allotment 14, Block XI, D.P. 601, Belleknowes Estate. As the said portion of street is more particularly delineated on the plan marked P.W.D. 112862, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.

The South-eastern Side of Portion of Beach Road and the South-western and Southern Sides of Portion of an unnamed Street, in the Borough of Richmond, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government Buildings at Wellington, this 3rd day of December, 1941.

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of every other power in anyway enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Richmond Borough Council, viz.:—
“That the Richmond Borough Council, being the local authority having control of the streets of the Borough of Richmond, by resolution passed this fourteenth day of October, one thousand nine hundred and forty-one, declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-eastern side of the portion of Beach Road nor to the south-western and southern sides of the portion of public road adjoining part Section 81, Waimea East, Block VII, Waimea Survey District”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Beach Road or the south-western and southern sides of the portion of an unnamed street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.
SCHEDULE.
THE south-eastern side of all that portion of street known as Beach Road and the south-western and southern sides of all that portion of an unnamed street situated in the Nelson Land District, Borough of Richmond, fronting part Section 81, Waimea East, Block VII, Waimea Survey District. As the same are more particularly delineated on the plan marked P.W.D. 112575, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

“The New Plymouth Borough Council, being the local authority having control of the streets in the Borough of New Plymouth, by resolution declares that the provisions of section one hundred and twenty-eight, subsection one of the Public Works Act, 1928, shall not apply to the southern side of the portion of Young Street adjoining Sections 615, 616, 617, part 618, and parts Mangaotuku Stream-bed and Mangaotuku Stream Deviation, Town of New Plymouth, Certificates of Title, Volume 134, folio 272, Volume 125, folio 48, Volume 134, folio 273, and Volume 134, folio 271, Taranaki Registry”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portion of Young Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE.
THE southern side of all that portion of street situated in the Taranaki Land District, Borough of New Plymouth, known as Young Street, fronting Section 615, Town of New Plymouth, D.P. 1482, Sections 616 and 617, Town of New Plymouth, part Section 618, part original bed of Mangaotuku Stream, and part of Mangaotuku Stream Deviation, Town of New Plymouth (part Lot 1, D.P. 713, and part land on D.P. 1261), part Section 618, part original bed of Mangaotuku Stream, and part of Mangaotuku Stream Deviation, Town of New Plymouth, part being shown on D.P. 2956. As the same is more particularly delineated on the plan marked P.W.D. 112811, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.
