Altering and Redefining the Boundaries of the Hawke’s Bay and the Southern Hawke’s Bay Rabbit Districts.—(Notice No. Ag. 3766.)

ORDER IN COUNCIL.

At the Government House at Wellington, this 14th day of August, 1940.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by section thirty-three of the Rabbit Nuisance Act, 1928 (hereinafter referred to as “the said Act”), it is enacted that the boundaries of two or more contiguous rabbit districts may from time to time be altered by the Governor-General in Council in accordance with a resolution proposing the alteration passed by the Board of each of the districts affected:

And whereas the districts known as the “Hawke’s Bay Rabbit District” and the “Southern Hawke’s Bay Rabbit District” (hereinafter referred to as “the said districts”) have been constituted and enure for the purposes of Part II of the said Act:

And whereas a resolution was passed by the Board of the Hawke’s Bay Rabbit District on the thirteenth day of March, one thousand nine hundred and forty, and a similar resolution was passed by the Board of the Southern Hawke’s Bay Rabbit District on the third day of July, one thousand nine hundred and forty, praying in each case for the alteration of the boundaries of the said districts in the manner described in the said resolutions and in the First Schedule hereto:

And whereas it is deemed expedient to alter and redefine the boundaries of the said districts in accordance with the said resolutions and in the manner hereinafter provided:

Now, therefore, in pursuance and exercise of the powers and authorities conferred upon him by the said Act, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby alter and redefine the boundaries of the said districts so constituted as aforesaid and doth hereby declare:—

(1) That the area described in the First Schedule hereto, being now part of the Hawke’s Bay Rabbit District shall be added to and form part of the Southern Hawke’s Bay Rabbit District;

(2) That the boundaries of the said districts shall be those set forth in Parts I and II respectively of the Second Schedule hereto; and,

(3) That this Order in Council shall take effect on the day following the date of the publication thereof in the Gazette.


FIRST SCHEDULE.

AREA EXCLUDED FROM THE HAWKE’S BAY RABBIT DISTRICT AND INCLUDED IN THE SOUTHERN HAWKE’S BAY RABBIT DISTRICT.

ALL that area in the Hawke’s Bay Land District containing 1,609 acres 3 roods, more or less, being parts of Sections 5 and 6, Block XV, Mangatoro Survey District, bounded as follows: Commencing at the northernmost point of Section 1, Block XVI, Mangatoro Survey District; thence south-westerly along the north-western boundary of the said Section 1, a distance of 1,700 links; thence due west along the northern boundary of Weber County to the eastern boundary of Lot 1, D.P. 6640, deposited in the office of the District Land Registrar at Napier; thence northerly along the eastern boundary of the said Lot 1 to its northernmost extremity; thence generally easterly along the southern boundaries of S.G.R. 73 and Section 2, Block XII, Mangatoro Survey District, to the intersection with the western boundary of Section 1, Block XIII, Porangahau Survey District; thence south-westerly along the western boundaries of Sections 1 and 3 and a road abuttal, Block XIII, Porangahau Survey District, to the point of commencement.

SECOND SCHEDULE.

PART I.

Boundaries of the Hawke’s Bay Rabbit District.

ALL that area in the Hawke’s Bay, Auckland, and Wellington Land Districts, comprising the Hawke’s Bay, Waipawa, and Waipukurau Counties, and parts of the Wairoa, Taupo, Rangitikei, and Patangata Counties as now constituted, and bounded as follows: Commencing at the point of intersection of the middle-line of the Taharua River with the south-eastern boundary of the Tauhara South A Block in Block V, Maruanui Survey District; thence proceeding north-easterly by a right line to the Rangitaiki River at the crossing of the main Napier–Taupo Road; thence south-easterly by that road to the middle of the Mohaka River; thence generally easterly down the middle of the Mohaka River to the sea; thence generally southerly along the sea-coast to Arataura; thence north-westerly along the north-eastern boundaries of Lots 11, 9, and 5, D.P. 1215, Blocks 49, 26, 50, 21, 30, and 55, Tautane Crown Grant District, Lot 1, D.P. 117, and Block 58 of the said Tautane Crown Grant District to the north-eastern corner of Section 4, Block I, Tautane Survey District, on the Patangata County boundary; thence north-westerly along the south-western boundary of the Patangata County as described in New Zealand Gazette, 1927, page 2929, to the northernmost corner of Section 1, Block XVI, Mangatoro Survey District, at its intersection with the eastern boundary of Section 5, Block XV, Mangatoro Survey District; thence northerly along that boundary of the said Section 5, Block XV, Mangatoro Survey District, to the south-eastern corner of Section 2, Block XII, Mangatoro Survey District; thence generally north-westerly along the eastern and northern boundaries of the Dannevirke County as described in New Zealand Gazette of 1926, page 126, to the summit of the Ruahine Range; thence northerly along the summit of the Ruahine Range to the south-western boundary of the Hawke’s Bay County; thence north-westerly by a right line to Trig. Station No. 30 on Aorangi; thence south-westerly by a right line between the said Trig. Station No. 30 and Trig. Station No. 32 to the middle-line of the Rangitikei River; thence northerly up the middle of the Rangitikei River to Taupo County boundary; thence generally easterly along the southern boundary of the Taupo County as described in New Zealand Gazette 1933, page 12, to the middle of the Mohaka River; thence northerly up the middle of that river and the Taharua River to the point of commencement.

PART II.

Boundaries of the Southern Hawke’s Bay Rabbit District.

ALL that area in the Hawke’s Bay and Wellington Land Districts comprising the Weber and Dannevirke Counties, and parts of the Woodville, Patangata, and Pahiatua Counties as now constituted, and bounded as follows: Commencing at a point on the summit of the Ruahine Range, being the northernmost point of the Dannevirke County; thence proceeding generally in a south-easterly direction along the northern and eastern boundaries of the Dannevirke County as described in New Zealand Gazette 1926, page 126, to the north-eastern corner of Section 5, Block XV, Mangatoro Survey District; thence generally southerly along the eastern boundary of Section 5, Block XV, Mangatoro Survey District, to its intersection with the northernmost corner of Section 1, Block XVI, Mangatoro Survey District; thence south-easterly along the south-western boundary of the Patangata County as described in New Zealand Gazette 1927, page 2929, to the north-eastern corner of Section 4, Block I, Tautane Survey District; thence along the north-eastern boundaries of Block 58, Tautane Crown Grant District, Lot 1, D.P. 117, Blocks 55, 30, 26, 21, 50, 26, and 49 of the said Tautane Crown Grant District, and Lots 5, 9, and 11, D.P. 1215, to the sea at Arataura; thence southerly and westerly along the sea-coast to the Waimata Stream; thence westerly along the southern boundaries of the Weber and Dannevirke Counties as described in New Zealand Gazette 1921, page 583, and New Zealand Gazette 1926, page 126, respectively, to and along the southern boundaries of Blocks XV, XVII, and XIII, Tahoraite Survey District, to the south-eastern corner of Section 5, Block IX, Woodville Survey District; thence along the southern boundary of the said Section 5 a distance of 791·3 links; thence through Sections 2, 4, and 1 (E.R.), Block II, Makuri Survey District, Pahiatua County, by right lines as delineated on plan marked L. and S. 92/327, deposited in the office of the Department of Agriculture, Wellington, to the southern boundary of the aforesaid Section 5, Block IX, Woodville Survey District; thence westerly along the southern boundary of Block IX, Woodville Survey District, to the middle-line of the Manawatu River; thence down the middle of the Manawatu River to the north-western boundary of Block XIV, Woodville Survey District; thence northerly along the north-western boundaries of Blocks XIV, XVI, and XV, Woodville Survey District, to Trig. Station No. 60A (Whariti), on the summit of the Ruahine Range; thence along the summit of the Ruahine Range to the point of commencement.
