COOK COUNTY COUNCIL.

SPECIAL RESOLUTION.

Made on 17th day of July, 1940.

IN pursuance and exercise of the powers vested in it in that behalf by the Local Bodies' Loans Act, 1926, the Cook County Council hereby resolves as follows:-

"That, for the purpose of providing the interest and other charges on a loan of £3,300, being the final instalment of a loan of £14,800, being the 10 per cent. additional loan on the works portion of a loan of £153,000, raised by a poll of ratepayers taken on the 5th day of November, 1924, authorized to be raised by the Cook County Council under the above-mentioned Act, for the formation, metalling, and bitumen-sealing of roads, renewal and erection of bridges, £14,800, and purchase of machinery and plant, £5,000, the said Cook County Council hereby makes and levies a special rate of one twenty-first of one penny in the £1 (pound) upon the rateable value of all rateable property of the County of Cook Special Rating District, comprising the whole of the rateable properties in the County of Cook; and that such special rate shall be an annual-recurring rate during the currency of such loan, and be payable yearly on the first day of July in each and every year during a period equal to the currency of such loan, being a period of eleven years or until the loan is fully paid off."

The rate of interest to be 4 (four) per cent.

The common seal of the Chairman, Councillors, and Inhabitants of the County of Cook was hereto affixed in the presence of-

COOK COUNTY COUNCIL.

NOTICE OF INTENTION TO TAKE LAND: ROYD'S ROAD.

In the matter of the Counties Act, 1920, and the Public Works Act, 1928.

NOTICE is hereby given that the Cook County Council proposes, under the provisions of the above-mentioned Acts, to execute a certain public work-namely, the formation and metalling of a road-and for the purposes of the said public work the lands described in the Schedule hereto are required to be taken: And notice is hereby further given that a plan of the lands so required to be taken is deposited in the office of the Clerk of the said County, situate at Childer's Road, Gisborne, New Zealand, and is open for inspection, without fee, by all persons during ordinary office hours.

All persons affected by the execution of the said public work or by the taking of such lands, who have any well-grounded objections to the execution of the said public work or to the taking of the said lands, must state their objections in writing, and send the same, within forty days from the first publication of this notice, to the County Clerk at the Council Chambers.

SCHEDULE.

Approximate area of the parcel of land to be taken is 3 roods and 34.2 perches, being Lot 18, Deposit Plan 1825, of part Whataupoko No. 1, situated in Block XIV, Waimata Survey District, of the County of Cook, in the Gisborne Land District, and coloured pink on plan 1551, brown.

IN VOLUNTARY LIQUIDATION.

NOTICE is hereby given that at an extraordinary general meeting of the above-named company duly convened and held on the 26th day of July, 1940, the following special resolution was duly passed:-

"That the company be wound up voluntarily."

WESTPORT BOROUGH COUNCIL.

RESOLUTION MAKING SPECIAL RATE.

Town Hall Supplementary Loan, 1940.

IN pursuance and exercise of the powers vested in it in that behalf by the Local Bodies' Loans Act, 1926, the Westport Borough Council hereby resolves as follows:-

"That, for the purpose of providing the interest and other charges on a loan of one thousand one hundred and fifty pounds (£1,150), authorized to be raised by the Westport Borough Council under the provisions of the above-mentioned Act, for the purpose of completing a new town hall and municipal offices and furnishing same, the said Westport Borough Council hereby makes and levies a special rate of four-fifths of one penny in the pound upon the rateable value (on the basis of the unimproved value) of all rateable property of the Borough of Westport, comprising the whole of the Borough of Westport; and that such special rate shall be an annual-recurring rate during the currency of such loan and payable yearly on the first day of July in each and every year during the currency of such loan, being a period of fifteen years, or until the loan is fully paid off."

Confirmed at the ordinary meeting of the said Council held on Wednesday, the 24th day of July, 1940.

We, John McLean Robertson and Arthur Taylor, Mayor and Town Clerk of the Borough of Westport, respectively, do hereby certify that the foregoing resolution is a true and correct extract of the minutes of proceedings of the Westport Borough Council at a special meeting of the said Council held on the 17th day of July, 1940, and confirmed at the Council meeting held on the 24th day of July, 1940.

Notice of Voluntary Winding Up.

NOTICE is hereby given that at an extraordinary general meeting of the above-named company duly convened and held on the 25th day of July, 1940, the following special resolution was duly passed:-

"That the company be wound up voluntarily.
"That Mr. G. D. STEWART, of Messrs. Barr, Burgess, and Stewart, Public Accountants, Wellington, be, and he is hereby appointed liquidator of the company."

PURSUANT to the provisions of section 222 of the Companies Act, 1933, notice is hereby given that by a resolution passed at a special meeting of the members of Nielsen Motor Bodies, Limited, held on Wednesday, the 24th July, it was resolved that the said company cannot by reason of its liabilities continue its business and that it be wound up.

THE liquidator of Nielsen Motor Bodies, Limited, which is being wound up voluntarily, doth hereby fix the 16th day of August, 1940, as the day on or before which the creditors of the company are to prove their debts or claims, and to establish any title they may have to priority under section 258 of the Act, or to be excluded from the benefit of any distribution made before such debts are proved, or, as the case may be, from objecting to such distribution.
