Declaring Portions of Road in the City of Auckland
to be under the Control and Management of the
Auckland City Council.

GALWAY, Governor-General.
ORDER IN COUNCIL.
At the Government House at Wellington, this 10th day of
July, 1940.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers vested in
him by the Public Works Act, 1928, and of all
other powers in anywise enabling him in this behalf,
His Excellency the Governor-General of the Dominion
of New Zealand, acting by and with the advice and
consent of the Executive Council of the said Dominion,
doth hereby order and declare that the portions of road
described in the Schedule hereto shall, on and after
the date of this Order in Council, be under the control
and management of the Auckland City Council.

P.W.D. 106766, deposited in the office of the Minister
of Public Works at Wellington, and thereon coloured
as above mentioned.

The South-western Side of Portion of Preston Crescent, in the
City of Dunedin, exempted from the Provisions of Section 128
of the Public Works Act, 1928, subject to a Condition as to
the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 24th day of
July, 1940.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of all other powers in
anywise enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the following
resolution, passed by the Dunedin City Council on the first
day of July, one thousand nine hundred and forty, viz. :—

“ That the Dunedin City Council, being the local
authority having control of the streets in the City of
Dunedin, by resolution declares that the provisions of
section one hundred and twenty-eight of the Public
Works Act, 1928, shall not apply to the south-western
side of portion of Preston Crescent abutting on Allotment
4, Block IV, D.P. 444, Belleknowes Estate ” ;

subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the south-
western side of the portion of Preston Crescent (described
in the Schedule hereto) within a distance of thirty-three feet
from the centre-line of the said portion of street.

SCHEDULE.

THE south-western side of all that portion of street in the
Otago Land District, City of Dunedin, known as Preston
Crescent, fronting Allotment 4, Block IV, D.P. 444, Belle-
knowes Estate. As the same is more particularly delineated
on the plan marked P.W.D. 108137, deposited in the office
of the Minister of Public Works at Wellington, and thereon
coloured red.

Extending the Open Season for the taking or killing of
Opossums in the Stratford Acclimatization District.

GALWAY, Governor-General.
ORDER IN COUNCIL.
At the Government House at Wellington, this 31st day of
July, 1940.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance of the powers conferred on him by
the Animals Protection and Game Act, 1921–22,
and of all other powers and authorities enabling him in
this behalf, His Excellency the Governor-General, acting
by and with the advice and consent of the Executive
Council, doth hereby amend the Order in Council made
under the said Act dated the fourteenth day of May,
one thousand nine hundred and forty, and appearing in
the New Zealand Gazette, number forty-three of the
sixteenth idem, at page 1065, by deleting the words
“1st August” appearing under the heading “Stratford
Acclimatization District” in the Schedule to such
Order in Council, and contained in Condition Number
One under the said heading, and by inserting in lieu
thereof the words “1st September.” And all licenses
issued to take or kill opossums in the Stratford
Acclimatization District under the authority of the said
Order in Council are hereby extended until noon on
the said first day of September, one thousand nine
hundred and forty.

Trustees of Waipapakauri Cemetery appointed.

GALWAY, Governor-General.

IN pursuance and exercise of the powers and authorities
vested in me by section fifty-five of the Cemeteries Act,
1908, I, George Vere Arundell, Viscount Galway, Governor-
General of the Dominion of New Zealand, do hereby appoint

The Mangonui County Council

to be the trustees of the Waipapakauri Cemetery as described
in the Schedule hereto, and to have the control and manage-
ment of the said cemetery.

SCHEDULE.

WAIPAPAKAURI CEMETERY.

ALL that area in Mangonui County containing by admeasure-
ment 4 acres 0 roods 29 perches, more or less, being portion
of Section 7, Block VIII, Opoe Survey District, bounded :
Commencing at the south-western corner of Lot 8 on D.P.
27209, being a subdivision of Maxwell’s Grant, in a westerly
direction generally along a public road for a distance of
824·6 links and 100 links ; thence along right lines bearing
51° 56′ distance 669·6 links, bearing 356° 19′ distance
