THE NEW ZEALAND GAZETTE.
The North-western Side of Portion of Seafield View Road,
in the City of Auckland, exempted from the Provisions of
Section 128 of the Public Works Act, 1928, subject to a
Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 10th day of
July, 1940.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of all other powers in any-
wise enabling him in this behalf, His Excellency the Governor-
General of the Dominion of New Zealand, acting by and with
the advice and consent of the Executive Council of the said
Dominion, doth hereby approve of the following resolution
passed by the Auckland City Council on the twenty-seventh
day of June, one thousand nine hundred and thirty-five
(in so far as it affects the side and portion of street described
in the Schedule hereto), viz.:—
“ The Auckland City Council, being the local authority
having control of the streets in the City of Auckland,
by resolution declares that the provisions of section one
hundred and twenty-eight of the Public Works Act,
1928, shall not apply to that portion of Seafield View
Road adjoining Lot 19 of Allotment 21, Section 3,
Suburbs of Auckland, comprised in 7A 691 ”;
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the north-
western side of the portion of Seafield View Road (described
in the Schedule hereto) within a distance of thirty-three
feet from the centre-line of the said portion of street.
SCHEDULE.
THE north-western side of all that portion of street, situated
in the North Auckland Land District, City of Auckland,
known as Seafield View Road fronting Lot 19 of Allotment 21,
Section 3, Suburbs of Auckland. As the same is more
particularly delineated on the plan marked P.W.D. 89944,
deposited in the office of the Minister of Public Works at
Wellington, and thereon coloured red.

Revoking the Declaration of Main Highways and
declaring Public Highways to be Main Highways.

ORDER IN COUNCIL.
At the Government House at Wellington, this 17th day of
July, 1940.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers and
authorities vested in him by section three of the
Main Highways Act, 1922, and of all other powers
in anywise enabling him in this behalf, His Excellency
the Governor-General of the Dominion of New Zealand,
acting by and with the advice and consent of the
Executive Council of the said Dominion, doth hereby
declare that on and after the date of publication of
this Order in Council in the Gazette, the portions of
main highways described in the First Schedule hereto
shall cease to be main highways, and doth further
declare that the roads described in the Second Schedule
hereto shall be main highways within the meaning and
for the purposes of the Main Highways Act, 1922.
FIRST SCHEDULE.
HIGHWAY DISTRICT No. 1.
Auckland-Maungaturoto.—All that main highway in
Otamatea County declared as the Auckland-Maunga-
turoto Main Highway, described in Orders in Council
dated 17th September, 1928, and 13th November, 1934,
and published in the Gazette on 20th September, 1928,
and 15th November, 1934, respectively.
Maungaturoto Railway-station-Waipu. — All that
main highway in the Counties of Otamatea and
Whangarei declared as the Maungaturoto Railway-
station-Waipu Main Highway, described in Order in
Council dated 9th June, 1924, and published in the
Gazette on 12th June, 1924.
Whangarei-Oakleigh. — All that main highway in
Whangarei County declared as the Whangarei-Oakleigh

Main Highway, described in Order in Council dated
9th June, 1924, and published in the Gazette on 12th
June, 1924.
Oakleigh-Waipu. — All that main highway in
Whangarei County declared as the Oakleigh-Waipu
Main Highway, described in Order in Council dated
29th October, 1930, and published in the Gazette on
30th October, 1930.
Lake Omapere-Maungaturoto via Whangarei. — All
that main highway in Whangarei County declared as
the Lake Omapere-Maungaturoto via Whangarei Main
Highway, described in Order in Council dated 27th
March, 1933, and published in the Gazette on 30th
March, 1933.
Dargaville-Maungaturoto.—All that main highway in
the Counties of Hobson and Otamatea and Dargaville
Borough declared as the Dargaville-Maungaturoto Main
Highway described in Orders in Council dated 25th
August, 1925, 23rd February, 1928, and 13th November,
1934, and published in the Gazette on 27th August,
1925, 24th February, 1928, and 15th November, 1934,
respectively.
SECOND SCHEDULE.
HIGHWAY DISTRICT No. 1.
Waipu Gorge.—All that road or portion of road in
the Counties of Whangarei and Otamatea commencing
at the junction with the Whangarei-Maungaturoto via
Waipu Main Highway in Allotment 42, Waipu Parish,
Block V, Waipu Survey District, and proceeding thence
generally in a south-westerly direction through the
Waipu Gorge to and terminating at the junction with
the Dargaville-Maungaturoto Main Highway at the
Maungaturoto Post-office at Grant’s Corner, being a
distance of 8 miles 70 chains, more or less; as the
same is more particularly delineated on plan P.W.D.
107323, deposited in the office of the Main Highways
Board at Wellington, and thereon coloured green.
Dargaville-Maungaturoto.—All that street or portion
of street in Dargaville Borough commencing at the
junction with the Whangarei-Dargaville Main Highway
at the junction of Jervois and Grey Streets and
proceeding thence generally in a south-easterly direction
and terminating at the Dargaville Borough boundary at
the northern end of the Wairoa River Bridge, being
a distance of 20 chains, more or less; as the same is
more particularly delineated on plan P.W.D. 107493,
deposited in the office of the Main Highways Board at
Wellington, and thereon coloured red.
Also all that road or portion of road in the Counties
of Hobson and Otamatea commencing at the Dargaville
Borough boundary at the northern end of the Wairoa
River Bridge and proceeding thence generally in a
south-easterly and then easterly direction through
Miti tai, Ruawai, and Maungaturoto and terminating at
the junction with the Whangarei-Maungaturoto via
Waipu and Birkenhead-Maungaturoto Main Highways,
being a distance of 44 miles 64 chains, more or less;
as the same is more particularly delineated on plan
P.W.D. 107323, deposited in the office of the Main
Highways Board at Wellington, and thereon coloured
green.
Whangarei-Maungaturoto via Waipu.—All that road
or portion of road in the Counties of Whangarei and
Otamatea commencing at the Whangarei Borough
southern boundary and proceeding thence generally in
a southerly, south-easterly, and southerly direction and
terminating at the junction with the Dargaville-
Maungaturoto and Birkenhead-Maungaturoto Main
Highways close to the north-western corner of Allot-
ment 106, Kaiwaka Parish, Block X, Waipu Survey
District, near Maungaturoto, being a distance of 34
miles 57 chains, more or less; as the same is more
particularly delineated on plan P.W.D. 107323,
deposited in the office of the Main Highways Board
at Wellington, and thereon coloured green.
Birkenhead-Maungaturoto.—All that road or portion
of road in Otamatea County commencing at the Topuni
River Bridge on the Otamatea County south-eastern
boundary and proceeding thence generally in a northerly
direction through Kaiwaka and terminating at the
junction with the Whangarei-Maungaturoto via Waipu
and Dargaville-Maungaturoto Main Highways close to
the north-western corner of Allotment 106, Kaiwaka
Parish, Block X, Waipu Survey District, near Maunga-
turoto, being a distance of 8 miles 63 chains, more or
less; as the same is more particularly delineated on
plan P.W.D. 107323, deposited in the office of the
Main Highways Board at Wellington, and thereon
coloured green.
