Authorizing the Laying-off of a Street (extension of Percy Street), in the Borough of Whangarei, of a Width less than 66 ft. but not less than 50 ft.

ORDER IN COUNCIL.

At the Government House at Wellington, this 10th day of July, 1940.

Present:

His Excellency the Governor-General in Council.

IN pursuance and exercise of the powers vested in him by the Municipal Corporations Act, 1933, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby authorize the Whangarei Borough Council to permit the laying-off of the proposed street described in the Schedule hereto of a width less than sixty-six feet, but not less than fifty feet.

SCHEDULE.

THAT proposed street in the North Auckland Land District, Borough of Whangarei, containing by admeasurement 1 rood 26 perches, more or less, being portion of part Lot 1 and Lot 2, Deeds Plan 655, and Lot 12A, Deeds Plan W 81, being parts Allotment 2, Parish of Whangarei. As the same is more particularly delineated on the plan marked P.W.D. 103378, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red and green.

The Northern Side of Portion of Wellington Road, in the City of Wellington, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government House at Wellington, this 10th day of July, 1940.

Present:

His Excellency the Governor-General in Council.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Wellington City Council, on the twentieth day of March, one thousand nine hundred and forty, viz:-

"That the Wellington City Council, being the local authority having control of the streets in the City of Wellington, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the northern side of Wellington Road fronting Lot 1, D.P. 3466, and part Lot 42, D.P. 65";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the northern side of the portion of Wellington Road (described in the Schedule hereto) within a distance of thirty-five feet from the centre-line of the said portion of street.

SCHEDULE.

THE northern side of all that portion of street, situated in the Wellington Land District, City of Wellington, known as Wellington Road, fronting Lot 1, D.P. 3466, and parts Lot 42, D.P. 65, being parts Section 4, Evans Bay District. As the same is more particularly delineated on the plan marked P.W.D. 107350, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The Northern Side of Portion of King Edward Street, in the Borough of Motueka, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

GALWAY, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this 10th day of July, 1940.

Present:

His Excellency the Governor-General in Council.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Motueka Borough Council on the twelfth day of March, one thousand nine hundred and forty (in so far as it affects the portion and side of the street described in the Schedule hereto), viz. :-

"The Motueka Borough Council, having control of Streets in the Borough of Motueka, hereby resolves that section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of King Edward Street fronting the southern boundary of Lot 4, D.P. 1481, part Section 165, N.R., Motueka Survey District";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the northern side of the portion of King Edward Street (described in the Schedule hereto) within a distance of thirty-five feet from the centre-line of the said portion of street.

SCHEDULE.

THE northern side of all that portion of street, situated in the Nelson Land District, Borough of Motueka, known as King Edward Street, fronting Lot 4, D.P. 1481 (now all D.P. 2950), being part Section 165, N.R., Motueka District. As the same is more particularly delineated on the plan marked P.W.D. 107440, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The South-western and North-western Sides of Portion of Carrick Place, in the Borough of Mount Eden, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

GALWAY, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this 17th day of July, 1940.

Present:

His Excellency the Governor-General in Council.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Mount Eden Borough Council on the twenty-first day of May, one thousand nine hundred and forty (in so far as it affects the portion and sides of street described in the Schedule hereto), viz. :-

"That this Council declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of Carrick Place fronting part of Allotment 8, Section 10, Suburbs of Auckland, being all the land comprised in Certificates of Title, 33/27 and 350/140, as shown coloured red on accompanying plans";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western and north-western sides of the portion of Carrick Place (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
