Regexations under the Naval Defence Act, 1913, amended.

GALWAY, Governor-General.
ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 25th day of
January, 1940.
Present:
THE HON. W. NASH PRESIDING IN COUNCIL.
In pursuance and exercise of the powers and authorities conferred on him
by section twenty-five of the Naval Defence Act, 1913, and of all
other powers and authorities enabling him in that behalf, His Excellency
the Governor-General, with the advice of the Executive Council, doth hereby
amend and supplement the regulations referred to in the Schedule hereto as
shown therein.

SCHEDULE.
Regulations for the Government and Payment of the New Zealand
Naval Forces, 1939.
Article 10: Cancel paragraph 2: Renumber paragraph 3.
Article 20: Insert:—
“20. Ship’s Agents.—The Naval Agency and Distribution Act, 1864
(Imperial), shall apply mutatis mutandis to the New Zealand Naval Forces
as hereinafter modified and in this article is referred to as ‘the said Act.’
“2. Section 22 of the said Act shall not apply to the New Zealand Naval
Forces.
“3. All Royal Proclamations and Orders in Council in force under the
said Act shall apply mutatis mutandis to the New Zealand Naval Forces.
“4. In the application of the said Act to the New Zealand Naval Forces,
references therein and in any Proclamations and Orders in Council in force
thereunder to the persons, institutions, and matters set out in column (1)
of the following table shall be read as references to the persons, institutions,
and matters set out in column (2) thereof:—

TABLE OF MODIFICATIONS.

References in the said Act to Shall be read as references to
The High Court of Admiralty The Supreme Court of New Zealand.
The Admiralty, The Lords Commissioners of the Admiralty The Naval Board of New Zealand.
Ships of war, His Majesty's ships of war Vessels of the New Zealand Naval Forces.
The Accountant-General of the Navy (Director of Navy Accounts) The Naval Secretary.
The General Post Office, London The Chief Post Office at Wellington, New Zealand.
The Bank of England The Reserve Bank of New Zealand or other bank at which for the time being the Public Account is kept.
The Consolidated Fund of the United Kingdom The Public Account.

“5. In pursuance of section 4 of the said Act, and in accordance with
Article 675 of the King’s Regulations and Admiralty Instructions, the
Commanding Officers of H.M. Ships of the New Zealand Naval Forces now
in commission shall forthwith and the Commanding Officers of every ship
of the New Zealand Naval Forces hereafter commissioned shall on com-
missioning appoint a Ship’s Agent so that matters relating to salvage and
prize may be dealt with in accordance with the law.
