JUNE 27.]\nTHE NEW ZEALAND GAZETTE.\n\nThe South-eastern Side of Portion of Hill Street and the North-western Side of Portion of Ross Street, in the Borough of West Harbour, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.\n\nGALWAY, Governor-General.\nORDER IN COUNCIL.\nAt the Government House at Wellington, this 26th day of June, 1940.\nPresent :\nHIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.\nIN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anyway enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the West Harbour Borough Council on the second day of April, one thousand nine hundred and forty (in so far as it affects the portions and sides of streets described in the Schedule hereto), viz.:β€”\n"The West Harbour Borough Council, being the local authority having control of the streets in the Borough of West Harbour, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of street known as Ross Street adjoining Allotments 5, 6, 7, and 8, Block VIII, and Hill Street adjoining Allotments 9, 10, 11, and 12, Block VIII, Second Extension of the Township of Rothesay and also being part of Section 59, Block IX, North Harbour and Blueskin District";\nsubject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Hill Street and the north-western side of the portion of Ross Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.\nSCHEDULE.\nTHE south-eastern side of all that portion of street, situated in the Otago Land District, Borough of West Harbour, known as Hill Street, fronting Lots 9, 10, 11, and 12, Block VIII, Deposited Plan 28, Second Extension of Township of Rothesay, being part Section 59, Block IX, North Harbour and Blueskin Survey District.\nAlso the north-western side of all that portion of street in the said land district and borough known as Ross Street, fronting Lots 5, 6, 7, and 8, Block VIII, Deposited Plan 28, Second Extension of Township of Rothesay, being part Section 59, Block IX, North Harbour and Blueskin Survey District.\nAs the same are more particularly delineated on the plan marked P.W.D. 107099, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.\nC. As the same is more particularly delineated on the plan marked P.W.D. 106212, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured yellow.\nC. A. JEFFERY,\nClerk of the Executive Council.\n(P.W. 51/2517.)\nOfficers authorized to take and receive Statutory Declarations.\nGALWAY, Governor-General.\nPURSUANT to the authority conferred upon me by the three-hundred-and-first section of the Justices of the Peace Act, 1927, I, George Vere Arundell, Viscount Galway, the Governor-General of the Dominion of New Zealand, do hereby notify and declare that the persons whose names are set out in the Schedule hereto, being officers in the service of the Crown holding the offices stated opposite their names respectively in the said Schedule, are authorized to take and receive statutory declarations under the three-hundred-and-first section of the Justices of the Peace Act, 1927.\nSCHEDULE.\nAubrey Dormer Baggs, Superintending Engineer, General Post Office.\nHerbert Pringle, Assistant Accountant, Christchurch.\nJack Paice, Postmaster, Frankton Junction.\nBernard James Smith, Postmaster, Kaiwaka.\nWilliam McCoard, Postmaster and Telephonist, Matau.\nArthur Lyall Ray, Cadet in Charge, Mokai.\nErnest Charles Hardie, Accountant, New Plymouth.\nWilliam Alfred Davies, Postmaster, Tapanui.\nMrs. Freda Hannah Gorrie, Postmistress and Telephonist, Tutamoe.\nMalcolm Edward Titchener, Postmaster, Whangamomona.\nAs witness the hand of His Excellency the Governor-General, this 19th day of June, 1940.\nH. MASON, Minister of Justice.\nOfficer authorized to take and receive Statutory Declarations.\nGALWAY, Governor-General.\nPURSUANT to the authority conferred upon me by the three-hundred-and-first section of the Justices of the Peace Act, 1927, I, George Vere Arundell, Viscount Galway, the Governor-General of the Dominion of New Zealand, do hereby notify and declare that John Findlay Henderson, being an officer in the service of the Crown holding the office of Assistant Engineer for the Public Works Department at Hollyford Valley, is authorized to take and receive statutory declarations under the three-hundred-and-first section of the Justices of the Peace Act, 1927.\nAs witness the hand of His Excellency the Governor-General, this 19th day of June, 1940.\nH.
