Haywards–Pahautanui.—All that main highway in Hutt County, declared as the Haywards–Pahautanui Main Highway, described in Order in Council dated 3rd April, 1940, and published in the Gazette on the 4th April, 1940.
Pahautanui–Plimmerton.—All that main highway in Hutt County, declared as the Pahautanui–Plimmerton Main Highway, described in Orders in Council dated 2nd July, 1928, and 7th October, 1933, and published in the Gazette on 5th July, 1928, and 12th October, 1933, respectively.
SECOND SCHEDULE.
HIGHWAY DISTRICT NO. 9.
Haywards–Paremata via Pahautanui.—All that road or portion of road in the Hutt County, commencing at its junction with the Western Hutt Main Highway at Haywards, and proceeding thence generally in a north-westerly and then westerly direction and terminating at its junction with the Levin–Wellington Main Highway at Paremata near the southern end of the Paremata Bridge over the Porirua Harbour, being a distance of 9 miles 40 chains, more or less; as the same is more particularly delineated on plan P.W.D. 106836, deposited in the office of the Main Highways Board at Wellington, thereon coloured green and blue, and marked A–B–C.
Pahautanui–Plimmerton.—All that road or portion of road in the Hutt County, commencing at its junction with the Haywards–Paremata via Pahautanui Main Highway near Pahautanui, and proceeding generally in a northerly, then westerly and then northerly direction and terminating at the junction of Steyne Avenue and Motuhara Road in Plimmerton Township, being a distance of 4 miles 55 chains, more or less; as the same is more particularly delineated on plan P.W.D. 106836, deposited in the office of the Main Highways Board at Wellington, thereon coloured blue and black, and marked B–D–E.

The Southern Side of Portion of Whakarewa Street, in the Borough of Motueka, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.
GALWAY, Governor-General.
ORDER IN COUNCIL.
At the Government House at Wellington, this 5th day of June, 1940.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Motueka Borough Council on the nineteenth day of February, one thousand nine hundred and forty, viz. :—
“ That the Motueka Borough Council, being the local authority controlling the streets in the Borough of Motueka, hereby declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of the southern half of Whakarewa Street fronting the northern boundary of Lot 2, D.P. 1511, being part Section 163 N.R., Motueka Original, Block IV, Motueka Survey District ” ;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portion of Whakarewa Street (described in the Schedule hereto) within a distance of thirty-five feet from the centre-line of the said portion of street.
SCHEDULE.
THE southern side of all that portion of street in the Nelson Land District, Borough of Motueka, known as Whakarewa Street, fronting Lot 2, D.P. 1511, being part Section 163, Motueka Original (Native Reserve), Block IV, Motueka Survey District. As the same is more particularly delineated on the plan marked P.W.D. 107161, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

“ That the Devonport Borough Council, being the local authority having control of streets in the Borough of Devonport, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the southern side of portion of Mozley Avenue abutting on part Allotment 9 of Section 2, Parish of Takapuna, comprised in Certificate of Title, Vol. 565, folio 275 ” ;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portion of Mozley Avenue (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.
SCHEDULE.
THE southern side of all that portion of street, situated in the North Auckland Land District, Borough of Devonport, known as Mozley Avenue, fronting part Allotment 9, Section 2, Parish of Takapuna. As the same is more particularly delineated on the plan marked P.W.D. 107380, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Notice of taking Land at New Plymouth under the Harbours Act, 1923, for Railway Purposes.
GALWAY, Governor-General.
BY virtue and in pursuance of the power and authorities vested in me by sections one hundred and forty, one hundred and forty-one, and one hundred and forty-two, of the Harbours Act, 1923, I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, do hereby, on behalf of His Majesty the King, give notice to the New Plymouth Harbour Board that one month from the date hereof I shall enter upon and take possession of the land described in the Schedule hereto, for railway purposes.
