SCHEDULE.
THE eastern side of all that portion of road in the Marlborough Land District, County of Marlborough, known as Ben Morven Road, fronting parts Sections 34 and 35, District of Omaka, Block III, Taylor Pass Survey District.
Also the northern side of all those portions of an unnamed road in the said land district and county fronting Lot 1 of Section 33, and part Section 35, District of Omaka, Block III, Taylor Pass Survey District.
As the same are more particularly delineated on the plan marked P.W.D. 106843, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The Eastern Side of Portions of a Road, in the County of Waikouaiti, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 22nd day of May, 1940.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waikouaiti County Council on the thirtieth day of January, one thousand nine hundred and forty (the portions of road affected by such resolution being more particularly described in the Schedule hereto), viz.:
“ That the Waikouaiti County Council, being the local authority having control of the roads in the Waikouaiti County, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the portion of the said road in the Waikouaiti County abutting part Section 26, Block 4, Hawksbury Survey District. The said portion of the road is more particularly shown on the plan annexed hereto ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the eastern side of the portions of road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portions of road.

As the same are more particularly delineated on the plan marked P.W.D. 106751, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The Western Side of Portion of Sydenham Street, in the City of Wellington, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government House at Wellington, this 29th day of May, 1940.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Wellington City Council on the seventeenth day of May, one thousand nine hundred and thirty-nine, viz.:
“ The Wellington City Council, being the local authority having control of the streets in the City of Wellington, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that part of the western side of Sydenham Street, fronting Lots 72 and 73, Deeds Plan 108 ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of Sydenham Street (described in the Schedule hereto) within a distance of thirty-five feet from the centre-line of the said portion of street.
SCHEDULE.
THE western side of all that portion of street, situated in the Wellington Land District, City of Wellington, known as Sydenham Street, fronting Lots 72 and 73, Deeds Plan 108, being part Section 31, Karori District. As the same is more particularly delineated on the plan marked P.W.D. 104474, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Portions of Roads in the County of Waimea exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.
GALWAY, Governor-General.
ORDER IN COUNCIL.
At the Government House at Wellington, this 29th day of May, 1940.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolutions passed by the Main Highways Board and the Waimea County Council on the twentieth day of March, one thousand nine hundred and forty, and on the tenth day of November, one thousand nine hundred and thirty-nine, respectively, viz.:
“ The Main Highways Board, being the local authority having control of the Nelson-Westport Main Highway, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the western side of the portion of the said highway fronting part Section 38, Square 5, Block VIII, Tadmor Survey District, and the portion of the said highway passing through part Section 39, and Section 40, Square 5, Block VIII, Tadmor Survey District ”;
“ That the Waimea County Council, being the local authority having control of the roads within the Waimea County, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the southern side of the road fronting the northern boundary of part Section 39, Square 5, Block VIII, Tadmor Survey District, and the northern side of the road fronting the southern boundary of Section 40, Square 5, Block VIII, Tadmor Survey District, as shown on plan prepared by F. A. C. Staig, Registered Surveyor, and coloured red thereon (R. Arnold) ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of the Nelson-Westport Main Highway (first described in the Schedule hereto), or fronting the portion of the said main highway (secondly described in the Schedule hereto), or fronting the southern side of the road (thirdly described in the Schedule hereto), or fronting the northern side of the road (fourthly described in the Schedule hereto), within a distance of thirty-five feet from the centre-lines of the said portions of roads.
SCHEDULE.
FIRST, the western side of all that portion of road, situated in the Nelson Land District, County of Waimea, known as the Nelson-Westport Main Highway, fronting part Section 38, Square 5, Block VIII, Tadmor Survey District.
