conferred on him by section eleven of the Local Government
Loans Board Act, 1926, as set out in section twenty-nine of
the Finance Act, 1932 (No. 2), and of all other powers and
authorities enabling him in this behalf, doth hereby vary
the determinations aforesaid in respect of the said sum by
prescribing that in lieu of a rate of interest not exceeding
three pounds ten shillings (£3 10s.) per centum per annum,
as specified in clause two of the said Order in Council, the
rate of interest that may be paid in respect of the said sum
shall be such as shall not produce to the lender or lenders a
rate exceeding three pounds seventeen shillings and sixpence
(£3 17s. 6d.) per centum per annum.

Validating Proceedings in connection with the Waipawa County
Council's Loan of £45,000.

GALWAY, Governor-General.
ORDER IN COUNCIL.
At the Government House at Wellington, this 22nd day of
May, 1940.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS the Waipawa County Council instituted
proceedings in connection with the raising of a loan
of forty-five thousand pounds (£45,000) (hereinafter referred
to as "the said loan") under the provisions of the Local
Bodies' Loans Act, 1913 (hereinafter referred to as "the
said Act") for the purpose of constructing and reconstructing
main highways and bridges :
And whereas the proceedings in connection with the said
loan were irregular or defective in that the notice published
pursuant to section nine of the said Act, although published
four times, was not published once in each week for four
successive weeks as required by that section :
And whereas it appears that the ratepayers of the district
have not been misled by such irregularity or defect as afore-
said, and it is expedient to validate the same :
Now, therefore, His Excellency the Governor-General of
the Dominion of New Zealand, in pursuance of the powers
conferred on him by section one hundred and twenty-two
of the Local Bodies' Loans Act, 1926, and of all other powers
and authorities enabling him in that behalf, and acting by
and with the advice and consent of the Executive Council
of the said Dominion, doth hereby order and declare that
the proceedings in connection with the said loan shall be
valid to all intents and purposes as though the said notice
had been correctly published and that the validity of the
proceedings in connection with the said loan or of the
security for the said loan shall not be called in question by
reason only of the irregularity or defect aforesaid.

Member appointed to Cape Kidnapper Bird Sanctuary Board.

GALWAY, Governor-General.
ORDER IN COUNCIL.
At the Government House at Wellington, this 29th day of
May, 1940.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by an Order in Council dated the seventeenth
day of August, one thousand nine hundred and
thirty-eight, and published in the Gazette of the eighteenth
day of that month, the control of the land described in the
Schedule to that document, being a reserve for the protection
of gannets, was vested in certain persons therein named, who
were by the said Order in Council constituted a special
Board, by the name of the Cape Kidnapper Bird Sanctuary
Board, in pursuance of section seventeen of the Public
Reserves, Domains, and National Parks Act, 1928 :
And whereas it is desirable that Peter William George
Barlow, should be appointed a member of the said Board
in place of Horace Spence Cottrell, resigned :
Now, therefore, His Excellency the Governor-General of
he Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion,
and in pursuance and exercise of the powers conferred on him
by section seventeen of the Public Reserves, Domains, and
National Parks Act, 1928, doth hereby appoint the said
Peter William George Barlow
to be a member of the Cape Kidnapper Bird Sanctuary
Board, constituted by the Order in Council dated the seven-
teenth day of August, one thousand nine hundred and thirty-
eight, hereinbefore referred to, in place of the said Horace
Spence Cottrell, resigned.

Amending the Description of a Reserve vested in the Lyttelton Borough Council.

GALWAY, Governor-General.
ORDER IN COUNCIL.
At the Government House at Wellington, this 29th day of
May, 1940.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by an Order in Council dated the sixth
day of September, one thousand nine hundred and
twenty, and published in the Gazette of the ninth day of that
month, Reserve No. 46, situated in the Borough of Lyttelton,
Canterbury Land District, was vested in the Mayor,
Councillors, and Burgesses of the Borough of Lyttelton, in
trust, for a public cemetery, in terms of section four of the
Public Reserves and Domains Act, 1908 :
And whereas an error was made in the area of the said
reserve in the Schedule to the said Order in Council, and
it is expedient that the error should be rectified :
Now, therefore, His Excellency the Governor-General of
the Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion,
and in pursuance and exercise of the powers conferred upon
him by the Public Reserves, Domains, and National Parks
Act, 1928, and of every other power and authority enabling
him in this behalf, doth hereby amend the Schedule to the
said Order in Council dated the sixth day of September, one
thousand nine hundred and twenty, and hereinbefore referred
to, by substituting the description and area of the said reserve
as set forth in the Schedule hereto in lieu of the description
and area of the said reserve as set forth in the Schedule to
the said Order in Council dated the sixth day of September,
one thousand nine hundred and twenty.

SCHEDULE.
All that area in the Canterbury Land District containing
by admeasurement 1 acre, more or less, and being Reserve
No. 46, situated in the Borough of Lyttelton.

Changing the Purpose of a Reserve in Village of Murchison, Nelson Land District.

GALWAY, Governor-General.
ORDER IN COUNCIL.
At the Government House at Wellington, this 29th day of
May, 1940.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS the land described in the Schedule hereto
is a reserve duly set apart for municipal purposes :
And whereas it is expedient that the purpose of the reservation
over such land shall be changed to a reserve for a site for
buildings of the General Government :
Now, therefore, His Excellency the Governor-General
of the Dominion of New Zealand, acting by and with the
advice and consent of the Executive Council of the said
Dominion, and in exercise of the powers and authorities
conferred upon him by subsection one (a) of section seven
of the Public Reserves, Domains, and National Parks Act,
1928, doth hereby declare that the purpose of the reserve
described in the Schedule hereto is hereby changed from a
reserve for municipal purposes to a reserve for a site for
buildings of the General Government.

SCHEDULE.
NELSON LAND DISTRICT.
SECTION 43, Village of Murchison : Area, 1 acre 3 roods
8 perches, more or less.
