of the said Dominion, doth hereby approve of the following
resolution passed by the Dunedin City Council on the twenty-
sixth day of February, one thousand nine hundred and
forty, viz.:
“That the Dunedin City Council, being the local
authority having control of the streets in the City of
Dunedin, by resolution declares that the provisions of
section one hundred and twenty-eight of the Public
Works Act, 1928, shall not apply to the undermentioned
portions of streets, viz.:
“(a) The north-eastern side of portion of Allandale
Road, abutting on Allotment 28, Township
of Allandale; and
“(b) The north-western side of portion of Coney
Hill Road abutting on Allotment 28, Town-
ship of Allandale”;
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the north-
eastern side of the portion of Allandale Road and the north-
western side of the portion of Coney Hill Road (described
in the Schedule hereto) within a distance of thirty-three
feet from the centre-lines of the said portions of streets.

SCHEDULE.
The north-eastern side of all that portion of street known
as Allandale Road and the north-western side of all that
portion of street known as Coney Hill Road, situated in the
Otago Land District, City of Dunedin, fronting part Lot
28, Township of Allandale, D.P. 69, and being also part
Sections 8 and 9, Ocean Beach District. As the same are
more particularly delineated on the plan marked P.W.D.
106694, deposited in the office of the Minister of Public
Works at Wellington, and thereon coloured red.

The South-eastern Side of Portion of a Street, in the City of
Nelson, exempted from the Provisions of Section 128 of the
Public Works Act, 1928, subject to a Condition as to the
Building-line.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 23rd day
of April, 1940.
Present:
THE HON. P. FRASER PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of all other powers in
anywise enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the following
resolution passed by the Nelson City Council on the twentieth
day of December, one thousand nine hundred and thirty-nine,
viz.:
“That the Nelson City Council, being the local
authority having control of the streets of the City of
Nelson, by resolution declares that the provisions of
section one hundred and twenty-eight of the Public
Works Act, 1928, shall not apply to that portion of the
public street adjoining Lot 1 on Deposited Plan 11,
being part of Section 1181, City of Nelson, as shown on
the plan annexed hereto and thereon coloured red”;
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the south-
eastern side of the portion of street (described in the Schedule
hereto) within a distance of thirty-three feet from the centre-
line of the said portion of street.

SCHEDULE.
The south-eastern side of all that portion of street, situated
in the Nelson Land District, City of Nelson, fronting Lot 1,
D.P. 11, being part Section 1181. As the same is more
particularly delineated on the plan marked P.W.D. 106249,
deposited in the office of the Minister of Public Works at
Wellington, and thereon coloured red.

Section 128 of the Public Works Act, 1928, subject to a
Condition as to the Building-line.

provisions of section one hundred and twenty-eight
of the Public Works Act, 1928, shall not apply to that
portion of Victoria Road fronting Lots 16 and 17, Deeds
Plan 155, Township of Forbury Park”;
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the south-
eastern side of the portion of Victoria Road (described in
the Schedule hereto) within a distance of thirty-three feet
from the centre-line of the said portion of street.

SCHEDULE.
The south-eastern side of all that portion of street, situated
in the Otago Land District, Borough of St. Kilda, known as
Victoria Road, fronting Lots 16 and 17, Deeds Plan No. 155,
being also part of Application 12, Block XII, Dunedin and
East Taieri District. As the same is more particularly
delineated on the plan marked P.W.D. 105699, deposited
in the office of the Minister of Public Works at Wellington,
and thereon edged red.

Borough of Richmond, exempted from the Provisions of
Section 128 of the Public Works Act, 1928, subject to a
Condition as to the Building-line.

of Richmond, by resolution passed this twenty-seventh
day of February, one thousand nine hundred and forty,
declares that the provisions of section one hundred and
twenty-eight of the Public Works Act, 1928, shall not
apply to that portion of Oxford Street on the north-
eastern side part Section 7 of 26 Waima East, Block
VII, Waima Survey District, and to that portion of
Dorset Street on south-western side of said section
marked A–B and C–D, and coloured red on this plan”;
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the south-
western side of the portion of Oxford Street, or the north-
eastern side of the portion of Dorset Street (described in the
Schedule hereto) within a distance of thirty-three feet from
the centre-lines of the said portions of streets.
