Appointment of Cemetery Trustees revoked (Motueka Public Cemetery).

GALWAY, Governor-General.

IN pursuance and exercise of the powers and authorities vested in me by the Cemeteries Act, 1908, I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, do hereby revoke a certain Warrant dated the twenty-seventh day of May, one thousand nine hundred and two, and published in the Gazette on the fifth day of June of the same year, appointing trustees for the Motueka Cemetery as described in the Schedule hereto.

SCHEDULE.

MOTUEKA PUBLIC CEMETERY.

All that area in the Nelson Land District, containing by admeasurement 13 acres 3 roods 20 perches, more or less, being Sections 145 and 146, Block IV, Motueka Survey District.

As witness the hand of His Excellency the Governor-General, this 20th day of March, 1940.

Officers authorized to take and receive Statutory Declarations.

PURSUANT to the authority conferred upon me by the three-hundred-and-first section of the Justices of the Peace Act, 1927, I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, do hereby notify and declare that the persons whose names are set out in the Schedule hereto, being officers in the service of the Crown holding the offices stated opposite their names respectively in the said Schedule, are authorized to take and receive statutory declarations under the three-hundred-and-first section of the Justices of the Peace Act, 1927.

Declaring Morrinsville Borough Council’s Waterworks Reserve, and Section 73s, Te Miro Settlement, to be a Sanctuary under the Animals Protection and Game Act, 1921-22, Auckland Acclimatization District.

GALWAY, Governor-General.

IN pursuance of the powers conferred upon me by section six of the Animals Protection and Game Act, 1921-22 (hereinafter referred to as “the said Act”), I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, do hereby notify and declare the areas described in the Schedule hereto to be a sanctuary for the purposes of the said Act.

SCHEDULE.

Lot 1 on D.P. 21110, being portions Kiwitahi No. 2c, Sections 1 and 2 Blocks, Cambridge Survey District, being all the land contained and described in Certificate of Title, Vol. 475, folio 179 (Auckland Registry), and also Kiwitahi No. 2b Block, Cambridge Survey District, being all the land in Certificate of Title, Vol. 336, folio 246 (Auckland Registry), and also Section 73s, Te Miro Settlement.

As witness the hand of His Excellency the Governor-General, this 27th day of March, 1940.

Notifying the Proposed Exchange of Crown Land in the Canterbury Land District for other Land.

GALWAY, Governor-General.

WHEREAS by section one hundred and sixty of the Land Act, 1924, it is enacted that it shall be lawful for the Governor-General, whenever he deems it expedient in the public interest, to grant in fee-simple any area of Crown land which is subject to the provisions of the Land Act, 1924, in exchange for the fee-simple of any other land, and on any such exchange to pay or receive any sum by way of equality of exchange;

And whereas, in the opinion of the Governor-General, it is expedient to exchange the Crown land described in the First Schedule hereto for the land of equal value described in the Second Schedule hereto, and the owner of the land described in the Second Schedule has agreed to such exchange;

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in exercise of the aforesaid powers and authorities, doth hereby declare it is his intention to grant in fee-simple the area of Crown land described in the First Schedule hereto in exchange for the fee-simple of the land described in the Second Schedule.

FIRST SCHEDULE.

DESCRIPTION OF LAND AUTHORIZED TO BE EXCHANGED.

Canterbury Land District.

All that area containing by admeasurement 1 rood 39·8 perches, more or less, being Lot 1, Deposit Plan 11727, and being part Rural Section 336, situated in Block XV, Pigeon Bay Survey District, and bounded as follows: Towards the west by the Little Akaloa Road, 199·9 links; towards the north, east, and south by Lot 3, D.P. 5105, 249·7 links, 199·8 links, and 250 links respectively. As the same is more particularly delineated on the plan marked L and S. 1912/172a, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

SECOND SCHEDULE.

DESCRIPTION OF LAND TO BE OBTAINED IN EXCHANGE THEREFOR.

Canterbury Land District.

All that area containing by admeasurement 29 perches, more or less, being Lot 2, Deposit Plan 11727, and being part Rural Section 336, situated in Block XV, Pigeon Bay Survey District, and bounded as follows: Towards the west by the Little Akaloa Road, 47·55 links; towards the north and east by Lot 3, D.P. 5105, 341·77 links and 66 links respectively; towards the south by part Rural Section 336, 158 links; again towards the west by Lot 3, D.P. 11727, 79·8 links; and again towards the south by the said Lot 3, D.P. 11727, and Lot 2, D.P. 5105, 105 links and 86·8 links respectively. As the same is more particularly delineated on the plan marked L. and S. 1912/172b, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

Vesting the Control of a Scenic Reserve in the Akaroa Borough Council.

GALWAY, Governor-General.

IN pursuance and exercise of the powers and authorities conferred upon him by section thirteen of the Scenery Preservation Act, 1908 (hereinafter referred to as “the said Act”), His Excellency the Governor-General of the Dominion of New Zealand doth hereby vest the control of the scenic reserve described in the Schedule hereto (being land reserved under the said Act) in the Akaroa Borough Council, subject to the conditions hereinafter contained, that is to say:—

  1. The period for which the control of the reserve is hereby vested shall be five years from the date hereof, unless the reservation is previously altered or revoked under the said Act.

  2. The said Council shall prepare a report each year ending on the thirty-first day of March, together with a statement of receipts and expenditure in connection with the said reserve.
