THE NEW ZEALAND GAZETTE.

(hereinafter referred to as “the licensee”), a license subject to the conditions hereinafter set forth to take and use from Coopers Creek situated in Section 19007, Block III, Geraldine Survey District, in the Land District of Canterbury, for the purposes hereinafter set forth a stream of water not exceeding eight cubic feet per second at any one time.

And whereas by the Lower Clutha Improvement Act, 1938, the Inch Clutha River and Drainage Board and the Clutha River Board were dissolved and their functions merged in the Lower Clutha River Trust:

Now, therefore, in pursuance and exercise of the powers conferred by section one hundred and ninety of the Reserves and other Lands Disposal and Public Bodies Empowering Act, 1924, and of every other power and authority in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby amend the said Orders in Council published in a supplement to the New Zealand Gazette on the twenty-third day of August, one thousand nine hundred and twenty-six, and in the New Zealand Gazette on the fourteenth day of August, one thousand nine hundred and thirty, respectively, by deleting therefrom the references to the Inch Clutha River and Drainage Board and to the Clutha River Board and substituting therefor the words “The Lower Clutha River Trust”; and doth hereby appoint Alexander Renton, of Clutha, Retired Farmer, and Athol John McDonald Miller, of Balclutha, Civil Engineer, to be members of the Special Board created for the purpose of controlling the gates of the Kawarau Falls Dam.

Consenting to Land being taken for the Development of Water-power (Addington Substation) in the Borough of Riccarton.

IN pursuance and exercise of the powers vested in him by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the land described in the Schedule hereto being taken for the development of water-power.

CONDITIONS.

  1. IMPLIED CONDITIONS.
    THE conditions directed to be implied in all licenses by the Water-power Regulations, 1934, and the Electrical Supply Regulations, 1935, shall be incorporated in and shall form part of this license except in so far as the same may be inconsistent with the provisions hereof.

  2. LICENSE SUBJECT TO REGULATIONS.
    This license is issued under the Water-power Regulations, 1934, the Electrical Wiring Regulations, 1935, and the Electrical Supply Regulations, 1935, and is subject thereto and to any regulations made or to be made in amplification or amendment thereof or in substitution therefor.

  3. UTILIZATION OF WATER AND LOCATION OF HEADWORKS.
    Water shall be used under this license solely for the purpose of generating electricity up to a maximum capacity of 2 kilowatts at 230 volts direct current and shall be taken from the stream at the point in Section 19007, Block III, Geraldine Survey District, indicated on the plan marked P.W.D. 105563, deposited in the office of the Minister of Public Works at Wellington.

  4. GENERAL DESCRIPTION OF WORKS.
    The licensee is hereby authorized, subject to the conditions hereof, to construct, maintain, and use the following works for the purposes of this license, the approximate positions of the said works being indicated on the said plan P.W.D. 105563 :—
    (a) Headworks consisting of an intake with a water-race leading to the water-wheel, and power-house hereinafter referred to, giving a static head of approximately 6 ft.
    (b) A power-house with all necessary equipment, for generating electricity.
    (c) Tail-race leading from the said water-wheel to Coopers Creek.

  5. SYSTEM OF SUPPLY.
    The system of supply shall be as described in paragraph (d) of clause 21-01 of the Electrical Supply Regulations, 1935. The generating voltage and the transmission voltage shall be approximately 230 volts direct current.

  6. DURATION OF LICENSE.
    Unless sooner determined, this license shall continue in force until the 31st day of March, 1960, or until electrical energy is available from an Electric-power Board or other general public source, whichever is the earlier.

  7. RENTAL.
    For the purpose of assessing the annual rental payable in respect of this license, the licensee may install a suitable maximum-demand indicator to the satisfaction of the Inspecting Engineer of the Public Works Department, and failing such installation, the rental shall be assessed on the maximum generating capacity of the plant installed. The present plant is rated at 2 kilowatts.

At the Government House at Wellington, this 3rd day of April, 1940.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by a certain Order in Council published in the New Zealand Gazette on the twenty-third day of August, one thousand nine hundred and twenty-six, a Special Board was constituted for the purpose of controlling the gates of the Kawarau Falls Dam:

And whereas by such Order in Council Alexander Renton, Esquire, was appointed to such Special Board as the representative of the Inch Clutha River and Drainage Board:

And whereas by a certain Order in Council published in the New Zealand Gazette on the fourteenth day of August, one thousand nine hundred and thirty, Ernest Wilfred Hayman, Esquire, was appointed to such Special Board as the representative of the Clutha River Board:
