Recreation Reserve in Otago Land District brought under Part II of the Public Reserves, Domains, and National Parks Act, 1928.

ORDER IN COUNCIL.

At the Government House at Wellington, this 21st day of February, 1940.

Present:

His Excellency the Governor-General in Council.

BY virtue of the powers and authorities vested in me by the thirty-fourth section of the Public Reserves, Domains, and National Parks Act, 1928, I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, by and with the advice and consent of the Executive Council of the said Dominion, do hereby order and declare that the reserve for recreation in the Otago Land District described in the Schedule hereto shall be and the same is hereby brought under the operation of and declared to be subject to the provisions of Part II of the said Act, and such reserve shall hereafter form part of the Green Island Domain, and be managed, administered, and dealt with as a public domain by the Green Island Domain Board.

SCHEDULE.

OTAGO LAND DISTRICT.

ALL that area containing by admeasurement 2 acres 1 rood 26·4 perches, more or less, being part of Sections 73 and 74, Block V, Lower Kaikorai Survey District: Bounded, towards the west by Neill Street and Lot 1, D.P. 2133, 798·77 links; towards the north by other parts of Sections 74 and 73, 324·00 links; towards the east by Armstrong Street, 811·96 links; towards the south by Neill Street, 145·09 links; towards the west by other part of Section 73, 111·37 links; towards the south by other parts of Sections 73 and 74, 131·95 links; towards the east by other part of Section 74, 118·51 links; and towards the south by Neill Street, 35·05 links: be all the aforesaid measurements more or less. As the same is delineated on the plan marked L. and S. 1/61c, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

Withdrawing Land from the Operation of the Kauri-gum Industry Act, 1908.

ORDER IN COUNCIL.

At the Government House at Wellington, this 21st day of February, 1940.

Present:

His Excellency the Governor-General in Council.

WHEREAS by section one hundred and sixty-two of the Land Act, 1924, it is enacted that the Governor-General may, by Order in Council, on the recommendation of the Land Board, declare that any land comprised in a kauri-gum reserve shall, from a date to be specified in the Order, cease to be subject to the Kauri-gum Industry Act, 1908, and on and after the date so specified the land to which the Order relates shall become subject to the provisions of the Land Act, 1924:

And whereas the Land Board of the North Auckland Land District has duly passed a resolution recommending that the portion of the Opoe Kauri-gum Reserve Extension No. 2, as described in the Schedule hereto, be excepted from the operations of the Kauri-gum Industry Act, 1908, and it is expedient to give effect to such recommendation:

Now, therefore, I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon me by section one hundred and sixty-two of the Land Act, 1924, and acting by and with the advice and consent of the Executive Council of the said Dominion, do hereby order and declare that the portion of the Opoe Kauri-gum Reserve Extension No. 2, as described in the Schedule hereto, shall, from the twenty-ninth day of February, one thousand nine hundred and forty, cease to be subject to the Kauri-gum Industry Act, 1908.

SCHEDULE.

NORTH AUCKLAND LAND DISTRICT.

ALL that area in the Mangonui County, containing by admeasurement 236 acres 0 roods 1 perch, more or less, being part Opoe Kauri-gum Reserve Extension No. 2, situated in Blocks IV and V, Opoe Survey District (now known as Section 28, Block IV, and Sections 51, 96, and 97, Block V, Opoe Survey District), bounded: By a line commencing at the northernmost corner of Section 76, Block V, Opoe Survey District; thence in a southerly direction generally along the eastern boundary of Section 76 aforesaid, and the eastern extremity of a public road; thence along the south-eastern side of that road a distance of 2117·1 links; thence in an easterly direction generally following right lines bearing 138° 30′ distance 69·7 links, bearing 118° 38′ 30″ distance 817·0 links, the northern side of a public road and the generally northern boundaries of Section 48, Block V, Opoe Survey District, to the easternmost corner of that section; thence along the other part Opoe Kauri-gum Reserve Extension No. 2 following right lines bearing 77° 02′ distance 167·7 links, bearing 68° 06′ distance 554·1 links, bearing 63° 28′ distance 531·1 links, bearing 36° 18′ distance 348·2 links, bearing 344° 30′ 30″ distance 475·1 links, bearing 349° 47′ distance 388·0 links, bearing 30° 17′ distance 815·1 links, bearing 343° 56′ 30″ distance 638·7 links, and bearing 332° 09′ distance 1181·6 links, to the Okohine Stream; thence in a westerly direction generally down that stream to Section 42, Block V, Opoe Survey District; thence in a southerly direction generally along the north-eastern and south-eastern boundaries of Section 42 aforesaid, to the point of commencement. Be all the aforesaid measurements more or less. As the same is more particularly delineated on the plan marked L. and S. 9/1463A, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red. The North-eastern Side of Portion of a Road, in the County of Westland, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

GALWAY, Governor-General.
ORDER IN COUNCIL.

At the Government House at Wellington, this 21st day of February, 1940.

Present:

His Excellency the Governor-General in Council.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Westland County Council on the nineteenth day of September, one thousand nine hundred and thirty-nine (the portion of road affected by such resolution being more particularly described in the Schedule hereto), viz.:

“ The Westland County Council, being the local authority having control of the road reserves in Westland, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of road reserve (coloured red) fronting Sections 4 and 5 of proposed Town of Kaniere Extension No. 4 ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-eastern side of the portion of road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of road.

SCHEDULE.

THE north-eastern side of all that portion of road, situated in the Westland Land District, County of Westland, fronting Section 1788 and part Section 1705, Block I, Kaniere Survey District. As the same is more particularly delineated on the plan marked P.W.D. 105252, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.
