Vesting a Reserve in the Wairoa County Council.

GALWAY, Governor-General.
ORDER IN COUNCIL.
At the Government House at Wellington, this 21st day of February, 1940.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS the land described in the Schedule hereto has been duly set apart as a reserve for a site for a roadman’s cottage: And whereas, in the opinion of the Governor-General, it is expedient to vest the said reserve in the Chairman, Councillors, and Inhabitants of the County of Wairoa:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section nine of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby declare that from and after the day of the date hereof the reserve described in the Schedule hereto shall become vested in the Chairman, Councillors, and Inhabitants of the County of Wairoa, in trust, for a site for a roadman’s cottage.

Vesting a Reserve in the Auckland City Council.

ORDER IN COUNCIL.
At the Government House at Wellington, this 21st day of February, 1940.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS the land described in the Schedule hereto has been duly set apart as a reserve for water-conservation purposes: And whereas, in the opinion of the Governor-General, it is expedient to vest the said reserve in the Mayor, Councillors, and Citizens of the City of Auckland:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section nine of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby declare that from and after the day of the date hereof, the reserve described in the Schedule hereto shall become vested in the Mayor, Councillors, and Citizens of the City of Auckland, in trust, for water-conservation purposes.

SCHEDULE.

NORTH AUCKLAND LAND DISTRICT.

ALL that area in the Manukau County, containing by admeasurement 842 acres 2 roods 6 perches, more or less, being parts Allotments E 75 and 95, Otai Parish, situated in Block XIV, Wairoa Survey District, bounded: Towards the east by Allotment 94, Otai Parish (Climatic Reserve, Gazette 1903, page 262), the crossing of a public road, and again Allotment 94 aforesaid; towards the south by a public road; towards the west by part Allotment 95, Otai Parish, 4854·0 links; towards the south by parts Allotments 95 and E 75, Otai Parish, 71·2 links, 5·4 links, 12·1 links, and 2185·2 links; towards the east by part Allotment E 75 aforesaid, 4206·0 links; towards the south by Allotment 96, Otai Parish; towards the west by Allotment W 75; towards the north by parts Kiripaka Block, the crossing of a public road, again part Kiripaka Block, and Lots 1 and 2 on D.P. 14842, save and excepting Allotment 110, Otai Parish (Quarry Reserve), and an intersecting public road. As the same is more particularly delineated on the plan marked L. and S. 22/1017B, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon edged red. Vesting the Control of a Reserve in the Nevis Public Library Board.

GALWAY, Governor-General.
ORDER IN COUNCIL.
At the Government House at Wellington, this 21st day of February, 1940.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS the land described in the Schedule hereto is a reserve duly set apart for a site for a library: And whereas it is expedient that the control of the said reserve should be vested in a special Board as hereinafter provided:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in exercise of the powers and authorities conferred upon him by section seventeen of the Public Reserves, Domains, and National Parks Act, 1928, doth hereby vest the control of the reserve described in the Schedule hereto for the period of five years from the date hereof (unless previously amended or revoked under the said Act) in the undermentioned persons, namely:—

David John Adie,
Daniel McNaughton Paterson,
Ellis John Williams,
Francis Andrew McLean,
Stuart Edwin Jolly, and
George Stewart Brown,

who are hereby constituted for that purpose a special Board by the name of “the Nevis Public Library Board (hereinafter referred to as “the Board”), with the powers and subject to the conditions hereinafter contained, that is to say:—

  1. The Board shall meet for the transaction of business on the last Friday in each month at eight o’clock p.m., at the Nevis Public Library, or at such other time or place as may from time to time be fixed by the Board. The first meeting shall be held on Friday, the twenty-ninth day of March, one thousand nine hundred and forty.

  2. The members of the Board shall at their first meeting, and thereafter at the annual meeting hereinafter mentioned, elect one of themselves to be Chairman, who may join in the discussion, and shall have an original as well as a casting vote. The Chairman shall hold office until the election of his successor.

  3. Special meetings may be convened by the Chairman, provided that two days’ notice of any such meeting is given to each member, specifying the business to be transacted at such special meeting; and no other business than that so specified shall be transacted at such meeting.

  4. Any three members of the Board shall form a quorum. Any meeting may be adjourned from time to time.

  5. If at any meeting the Chairman is not present at the time appointed for holding the same, the members present shall choose one of their number to be Chairman of such meeting.

  6. If by resignation, death, incapacity, or otherwise the seat of any member shall be or become vacant, or if any member absents himself without reasonable cause from three consecutive meetings of the Board, the Governor-General shall have power to appoint any other person to be a member of the Board in his stead.

  7. All questions shall be determined by the majority of votes of the members of the Board present at a meeting.

  8. The Board shall have prepared and submitted at an annual meeting to be held in the month of April in each year a report of the proceedings of the Board for the previous year ending on the thirty-first day of March, together with a statement of the receipts and expenditure of the Board for such year. A copy of every such report and statement, certified by the Chairman to be correct, shall be sent to the Minister of Lands as soon as possible after each annual meeting.

  9. The Board shall control the said reserve and the building erected thereon for the purposes of a public library, and shall also afford settlers and residents of Nevis and the surrounding district such facilities for meeting within the said building as may from time to time be determined by the Board, provided that the Board shall have power to fix reasonable charges for the use of the said building.
