The Timber Industry Labour Legislation Suspension Order 1940.

WHEREAS it appears to me to be expedient for maintaining supplies and services essential to the life of the community, I, Patrick Charles Webb, Minister of Labour, pursuant to the Labour Legislation Emergency Regulations 1940, do hereby order as follows:—

  1. This Order may be cited as the Timber Industry Labour Legislation Suspension Order 1940.

  2. This order applies to workers in the timber industry who come within the scope of the New Zealand (except Canterbury) Timber Workers’ Award, dated the 17th day of June, 1940, and recorded in Book of Awards, Volume XL, page 833, and who are engaged in the production of timber for use in the manufacture of butter-boxes and to the employers of such workers in the Westland, Grey, and Inangahua Counties and also to the following employers, viz., Messrs. Ellis and Burnand, Limited (Ongarue and Manunui Mills), Whangaroa Timber Company, Limited, Rangiahua Sawmills, Limited, Tarawera Timber Company, Limited, C. R. Lovatt and Son, Limited, Wilson Timber Mills, Limited, Thompson Timber, Limited, Landing Sawmilling Company.

  3. The provisions of all Acts and all regulations thereunder and of the above-mentioned award shall be and are hereby suspended in so far as they operate to prevent eight hours’ overtime being worked each week at the rate of time and a half, in lieu of time and a half for the first four hours and double time thereafter, but such suspension shall be subject to the conditions hereinafter set forth.

  4. The overtime hereinbefore referred to shall be paid for at the rate of time and a half, calculated on the rates of wages received by the workers.

  5. All overtime worked in excess of eight hours in any week shall be paid for at the rate of double time, calculated on the rates of wages received by the workers.

  6. The operations covered by this Order shall, except in the case of breakdowns or other causes over which the employer has no control, be carried out for forty-eight hours in each week.

  7. This order may be extended so as to include any employer or mill in addition to those mentioned in clause 2 hereof if I am satisfied that such employer or mill is engaged in the operations covered by this Order.

  8. This Order shall come into operation on the date hereof.
