Varying the Determinations in respect of the Nelson Hospital Board’s Loan of £10,000.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 31st day of October, 1940.

Present:

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL.

WHEREAS by Order in Council made on the twenty-eighth day of August, one thousand nine hundred and forty, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising by the Nelson Hospital Board (hereinafter called “the said local authority”) of the sum of ten thousand pounds (£10,000) by a loan to be known as “Golden Bay Hospitals Loan, 1940” (hereinafter called “the said loan”):

And whereas the authority conferred by the said Order in Council has not yet been exercised, and it is expedient to vary the determinations aforesaid in respect of the said loan:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary the determinations aforesaid in respect of the said loan by prescribing that in lieu of repayment by equal aggregate annual or half-yearly instalments of principal and interest as specified in clause three of the aforesaid Order in Council the said loan shall be repaid by half-yearly instalments of principal of not less than two hundred pounds (£200) each.

The Southern Side of portion of Colquhoun Street, and the Northern Side of portion of Glasgow Street, in the County of Peninsula, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 31st day of October, 1940.

Present:

THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Peninsula County Council on the nineteenth day of September, one thousand nine hundred and forty, in so far as it affects the sides and portions of roads described in the Schedule hereto, viz.:

“The Peninsula County Council, being the local authority having control of roads and streets in the County of Peninsula, by resolution declares that section 128 of the Public Works Act, 1928, shall not apply to that portion of Colquhoun Street fronting Section 29, D.P. 150, Township of Helensburgh, or to that portion of Glasgow Street fronting Section 16, D.P. 150, Township of Helensburgh, as shown on the plan produced”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of the portion of Colquhoun Street and the northern side of the portion of Glasgow Street (described in the Schedule hereto), within a distance of thirty-three feet from the centre-lines of the said portions of roads.

SCHEDULE.

The southern side of all that portion of road, situated in the Otago Land District, County of Peninsula, known as Colquhoun Street, fronting Lot 29, D.P. 150, Township of Helensburgh, being also part Section 6, Upper Harbour East District.

Also the northern side of all that portion of road, situated in the said land district and county, known as Glasgow Street, fronting Lot 16, D.P. 150, Township of Helensburgh, being also part Section 6, Upper Harbour East District.

As the same are more particularly delineated on the plan marked P.W.D. 108953, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.

Officers authorized to take and receive Statutory Declarations.

PURSUANT to the authority conferred upon me by the three-hundred-and-first section of the Justices of the Peace Act, 1927, I, George Vere Arundell, Viscount Galway, the Governor-General of the Dominion of New Zealand, do hereby notify and declare that the persons whose names are set out in the Schedule hereto, being officers in the service of the Crown holding the offices stated opposite their names respectively in the said Schedule, are authorized to take and receive statutory declarations under the three-hundred-and-first section of the Justice of the Peace Act, 1927.
