Authorizing Laurence Manson, of Takaka, Farmer, to use Water for the Purpose of generating Electricity and to erect certain Electric Lines.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 31st day of October, 1940.

Present:
THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL.

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby grant to Laurence Manson, of Takaka, Farmer (hereinafter referred to as “the licensee”), a license subject to the conditions hereinafter set forth to obstruct, impound, or divert the waters of an unnamed stream situated in Section 2, Block III, Totaranui Survey District, in the Land District of Nelson, and to take and use therefrom for the purposes hereinafter set forth a stream of water not exceeding one cubic foot per second at any one time, and to erect the electric lines hereinafter described.

CONDITIONS.

  1. IMPLIED CONDITIONS.

THE conditions directed to be implied in all licenses by the Water-power Regulations, 1934, and the Electrical Supply Regulations, 1935, shall be incorporated in and shall form part of this license, except in so far as the same may be inconsistent with the provisions hereof.

  1. LICENSE SUBJECT TO REGULATIONS.

This license is issued under the Water-power Regulations, 1934, the Electrical Supply Regulations, 1935, and the Electrical Wiring Regulations, 1935, and is subject thereto, and to any regulations made or to be made in amplification or amendment thereof or in substitution therefor.

  1. UTILIZATION OF WATER AND LOCATION OF HEADWORKS.

Water shall be used under this license solely for the purpose of generating electricity, and shall be taken from the said stream at a point in Section 2, Block III, Totaranui Survey District, in the Nelson Land District, as indicated on the plan marked P.W.D. 108063, deposited in the office of the Minister of Public Works.

  1. GENERAL DESCRIPTION OF WORKS.

The licensee is hereby authorized, subject to the conditions hereof, to construct, maintain, and use the following works for the purposes of this license, the positions of the said works being indicated on the said plan P.W.D. 108063:—

(a) Headworks consisting of a weir and intake giving a static head of approximately 160 ft.

(b) Head-race and pipe-line from such headworks to the power-house hereinafter described.

(c) Power-house with all necessary equipment for generating electricity, all situated in part Section 1 of 11, Block III, Totaranui Survey District.

(d) Electric lines leading from the power-house aforesaid (i) Across a public road and the said stream to a worker’s dwelling in Section 21; and (ii) Across the public road aforesaid to the licensee’s dwelling in Section 1 of 11; all being situated in Block III, Totaranui Survey District, and being shown by means of broken white lines on the said plan P.W.D. 108063.

  1. DURATION OF LICENSE.

This license shall continue in force until the 31st day of March, 1961, or until electrical energy is available from an Electric-power Board or other public source of supply, whichever is the earlier.

  1. SYSTEM OF SUPPLY.

The system of supply shall be as described in paragraph (d) of clause 21-01 of the Electrical Supply Regulations, 1935. The generating voltage and the transmission voltage shall be approximately 230 volts direct current.

  1. RENTAL.

For the purpose of assessing the rental or annual sum payable in respect of this license, the licensee may install a suitable maximum-demand indicator to the satisfaction of the Inspecting Engineer of the Public Works Department, and, failing such installation, the rental shall be determined on the maximum capacity of the generating plant installed. The present plant is rated at 10 kilowatts.

Amending Regulations under the Discharged Soldiers Settlement Act, 1915.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 31st day of October, 1940.

Present:
THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL.

PURSUANT to the Discharged Soldiers Settlement Act, 1915, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby make the following regulations.

REGULATIONS.

  1. These regulations may be cited as the Discharged Soldiers Settlement Amending Regulations 1940.

  2. The regulations made under the Discharged Soldiers Settlement Act, 1915, on the 8th day of March, 1926, and published in the Gazette on the 18th day of the same month, are amended by adding to the list of statutory provisions applicable in terms of clause 14 of the said regulations Sections 80, 81, 82, and 83 of the Land Act, 1924.

Declaring Portion of Road in Blocks V and VI, Paekakariki Survey District, to be Government Road.

GALWAY, Governor-General.
ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 31st day of October, 1940.

Present:
THE RIGHT HON. P. FRASER PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers vested in him by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby order and declare that the portion of road described in the Schedule hereto shall, on and after the date of this Order in Council, become a Government road.

SCHEDULE.

APPROXIMATE area of the piece of road declared to be Government road: 22·8 perches.

Being formerly part Lot 13, D.P. 5508, being part Pukerua 3A 4 and 3C 1A and part closed road.

Situated in Blocks V and VI, Paekakariki Survey District. (S.O. 20552.)

In the Wellington Land District; as the same is more particularly delineated on the plan marked P.W.D. 108173, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.
