Prohibiting Alienation of Native Land.

ORDER IN COUNCIL.
At the Government House at Wellington, this 9th day of October, 1940.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
PURSUANT to section one hundred and sixty-seven of the Native Land Act, 1931, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby prohibit all alienation of the Native land described in the Schedule hereto, except as in the said section provided or in favour of the Crown.

Appointment of Officer for the Purpose of the Sale of Food and Drugs Act, 1908.
GALWAY, Governor-General.
IN pursuance and exercise of the powers and authorities conferred on me by section two of the Sale of Food and Drugs Act, 1908, I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, do hereby appoint
Constable Harry Lawrence Smith
to be an officer for the purposes of the Sale of Food and Drugs Act, 1908.
As witness the hand of His Excellency the Governor-General, this 9th day of October, 1940.

Lands temporarily reserved in the Wellington and Otago Land Districts.
GALWAY, Governor-General.
WHEREAS by the three-hundred-and-fifty-ninth section of the Land Act, 1924, it is enacted that the Governor-General may from time to time set apart temporarily as reserves, notwithstanding that the same may be then held under pastoral license, any Crown lands which in his opinion are required for any of the purposes in the said section mentioned:
Now, therefore, I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon me by the said Act, do hereby temporarily reserve the lands in the Wellington and Otago Land Districts described in the Schedule hereunder written for the purposes specified at the end of the respective descriptions of the lands so intended to be temporarily reserved.

SCHEDULE.
WELLINGTON LAND DISTRICT.
ALL that area in the City of Palmerston North containing by admeasurement 3 acres 0 roods 36 perches, more or less, being part of Suburban Section 1020, Township of Palmerston, bounded: On the south-west by Botanical Road, 586·37 links; on the north-west by other part of the said Suburban Section 1020, 550 links; towards the north-east by Suburban Section 1022, Township of Palmerston, 586·37 links; and towards the south-east by Park Road, 550 links; be all the aforesaid admeasurements a little more or less. As the same is more particularly delineated on a plan marked L. and S. 30/228/12B, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red. OTAGO LAND DISTRICT.
All that area containing 2 roods, more or less, being Lot 10, Papanui Small Farms Settlement, and being part of Section 59B, Block D, Papanui Native Reserve, bounded as follows: Commencing at a point on a public road 50 links north-east from old peg opposite Peg 25; thence towards the south-west, north-west, and north-east by Lot 4, 264·8, 192·3, and 264·8 links respectively; towards the south-east by aforesaid public road 192·3 links; be all the aforesaid linkages more or less. As the same is delineated on the plan marked L. and S. 6/6/788A, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red. (S.O. plan 2193.) Member appointed to Kirk’s Bush Scenic Board.
GALWAY, Governor-General.
WHEREAS by a Warrant dated the sixteenth day of April, one thousand nine hundred and forty, and published in the Gazette of the twenty-fourth day of that month, the control of a certain reserve in the North Auckland Land District, known as the Kirk’s Bush Scenic Reserve, was vested in certain persons therein named, who were by the said Warrant constituted a special Board by the name of the Kirk’s Bush Scenic Board, in pursuance of section thirteen of the Scenery Preservation Act, 1908: And whereas it is desirable that Frederick George Mullins should be appointed a member of the said Board in place of Bernard Charteris Carpenter, who has resigned:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred on him by section thirteen of the Scenery Preservation Act, 1908, and of all other powers and authorities enabling him in this behalf, doth hereby appoint the said
Frederick George Mullins
to be a member of the Kirk’s Bush Scenic Board constituted by the Warrant dated the sixteenth day of April, one thousand nine hundred and forty, hereinbefore referred to, in place of the said Bernard Charteris Carpenter.
As witness the hand of His Excellency the Governor-General, this 11th day of October, 1940.

Vesting the Control of a Scenic Reserve in the Lake Kaniere Scenic Board.
GALWAY, Governor-General.
IN pursuance and exercise of the powers and authorities conferred upon him by section thirteen of the Scenery Preservation Act, 1908, His Excellency the Governor-General of the Dominion of New Zealand doth hereby vest the control of the reserve described in the Schedule hereto (being land reserved under the said Act), for the period of five years from the date hereof (unless previously altered or revoked under the said Act), in the undermentioned persons, namely,—
The Mayor of Hokitika, ex officio,
The Chairman of the Westland County Council, ex officio,
The Commissioner of Crown Lands for the Westland Land District, ex officio,
The Conservator of Forests for the Westland Forest-conservation Region, ex officio,
Hugh Wood Gordon Park,
James Alexander Murdoch,
David John Evans, and
John Noble Robinson,
who are hereby constituted for that purpose a special Board by the name of the Lake Kaniere Scenic Board (herein referred to as “the Board”), in trust, for the preservation of scenery, and with the powers and subject to the conditions hereinafter contained, that is to say,—
- The first meeting of the Board shall be held on Monday, the eleventh day of November, one thousand nine hundred and forty, at half-past two o’clock p.m., in the office of the Commissioner of Crown Lands, Hokitika.
