Varying the Determinations in respect of the Hawke’s Bay Hospital Board’s Loan of £87,000.

ORDER IN COUNCIL.

At the Government House at Wellington, this 2nd day of October, 1940.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by Order in Council made on the twenty-ninth day of May, one thousand nine hundred and forty, and subject to the determinations as to borrowing and repayment therein set out consent was given to the raising by the Hawke’s Bay Hospital Board (hereinafter called “the said local authority”) of the sum of eighty-seven thousand pounds (£87,000) by a loan to be known as “Building Loan, 1939” (hereinafter called “the said loan”):

And whereas the said loan has not yet been raised and it is expedient to vary the determinations in respect thereof:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary the determinations aforesaid in respect of the said loan by prescribing that in lieu of provision being made for the repayment of the said loan by the establishment of a sinking fund as specified in clause three of the said Order in Council the said loan shall be repaid by the half-yearly redemption of debentures on the dates set out in the first column of the Schedule hereunder of the amounts stated opposite each such date in the second column of the said Schedule.

Validating Rate made and levied by Mackenzie County Council.

ORDER IN COUNCIL.

At the Government House at Wellington, this 9th day of October, 1940.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS the County Council of the Mackenzie County having omitted to record in the minutes of the meeting of the Council held on the seventh day of July, one thousand nine hundred and thirty-nine, the resolution making and levying a general rate (hereinafter referred to as the “said general rate”) of 1⅜d. in the pound on all rateable property within the said county for the year ended on the thirty-first day of March, one thousand nine hundred and forty, as required by section ninety-eight of the Counties Act, 1920 (hereinafter referred to as the “said Act”), it is expedient to validate the proceedings in connection with the making and levying of the said general rate:

Now, therefore, in pursuance and exercise of the power and authority vested in him by section two hundred and sixteen of the said Act, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby declare that the said general rate made and levied by the Mackenzie County Council on the seventh day of July, one thousand nine hundred and thirty-nine, shall be valid to all intents and purposes as if the resolution making and levying the said general rate had been duly recorded in the minutes of the proceedings as required by section ninety-eight of the said Act, and doth further declare that the said rate shall not be called in question by reason only of the irregularity aforesaid.

Restricting the Grant and Disposal of Mining Privileges over certain Lands in the Nelson Land District.

GALWAY, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this 9th day of October, 1940.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers vested in him by section thirty-four of the Statutes Amendment Act, 1940, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that from and after the date hereof no mining privileges shall be granted over the lands described in the Schedule hereto without the previous written consent of the Minister of Mines, and, further, that no mining privilege affecting such lands whether granted before or after the passing of the said Act shall be transferred or otherwise dealt with without the like consent.

New Plymouth Borough Council authorized to apply Portion of Closed Street for Purposes of its Electricity Undertaking.

GALWAY, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this 9th day of October, 1940.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the power conferred upon him by section one hundred and ninety-four of the Municipal Corporations Act, 1933, and of all other powers enabling him in this behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby approve of the New Plymouth Borough Council applying that portion of a closed street described in the Schedule hereto and situated in the Borough of New Plymouth to the purposes of its electricity undertaking.

SCHEDULE.

ALL that piece of land situated in the Land District of Taranaki containing by admeasurement 31·71 perches, more or less, being more particularly described as Section 2379 on the public maps of the Town of New Plymouth, being part of Leach Street (closed), in the Borough of New Plymouth.
