The South-western Side of Portion of Farquharson Street, and the North-western Side of Portion of Warden Street, in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 25th day of September, 1940.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the fifteenth day of July, one thousand nine hundred and forty, viz. :
“That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the undermentioned portions of streets, viz. :
“(a) The north-western side of portion of Warden Street, abutting on Lot 34, D.P. 26, Block 1, Township of Opopo ; and
“(b) The south-western side of portion of Farquharson Street, abutting on Lot 34, D.P. 26, Block 1, Township of Opopo ” ;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western side of portion of Farquharson Street (described in the Schedule hereto) and the north-western side of portion of Warden Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of streets.

SCHEDULE.
THE south-western side of all that portion of street in the Otago Land District, City of Dunedin, known as Farquharson Street, fronting Lot 34, Block I, Township of Opopo.
Also the north-western side of all that portion of street in the said land district and city, known as Warden Street, fronting Lot 34, Block I, Township of Opopo.
As the same are more particularly delineated on the plan marked P.W.D. 108252, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.

IN pursuance and exercise of the powers and authorities conferred on him by section twenty-five of the Naval Defence Act, 1913, and of all other powers and authorities enabling him in that behalf, His Excellency the Governor-General, with the advice of the Executive Council, doth hereby amend and supplement the regulations referred to in the Schedule hereto as shown therein.

SCHEDULE.
Regulations for the Government and Payment of the Royal Naval Reserves, 1937.
The following instructions are to be read in conjunction with the above regulations :
NEW ZEALAND ROYAL NAVAL RESERVE CLASS “C.”—GOOD SERVICE BADGES.
Good Service Badges are awarded to New Zealand Royal Naval Reserve Class “C” ratings as an encouragement to keenness and efficiency in the Reserve.

These badges are unpaid and may be awarded gratuitously, up to a maximum number of three, by Commanding Officers of H.M. Ships or Establishments in which the ratings are under training. On each occasion of ratings joining for training, their service certificates, N.Z. Navy R. 1, are to be scrutinized and the ratings awarded the badges for which they are due. Two or more badges may be awarded at the same time if a rating is eligible.

Service required to qualify :
For one badge .. .. .. 4 years.
For two badges .. .. .. 8 years.
For three badges .. .. .. 12 years.

Character.—During his previous period of training a rating’s character must have been assessed as “V.G.” The character awarded for the last period of training performed during the previous term of enrolment and the number of Good Service Badges in a rating’s possession are shown on the service certificate N.Z. Navy R. 1. In those cases where a man’s previous character is not shown it may be assumed that such character was “V.G.,” unless information is received to the contrary from the Director and Registrar of Naval Reserves.

The award of badges will lapse on mobilization, but deprivation and restoration of any badges held on mobilization will take place as provided in paragraphs 7–11, and badges earned prior to mobilization may be granted.

Time served during mobilization, or temporary service in the Naval Forces in response to a call for volunteers, will count towards the award of badges on return to the Royal Naval Reserve.

Deprivation.—A rating may be deprived, by the Commanding Officer of one of H.M. Ships or Establishments, of a badge or badges for an offence, committed under training or when mobilized, which is of sufficient gravity to warrant that course. Form S. 271, warrant for punishment, is not required and the forfeiture is not to be regarded as a punishment for the offence. The Director and Registrar of Naval Reserves is to be informed of all such deprivations and the offences that led to them.

A higher character assessment than “Good” is not to be awarded to a rating for the training in which he has been deprived of a badge or badges, but character assessments during mobilized service are to be governed by the rules laid down in King’s Regulations, the deprivation of a Good Service Badge not then necessarily entailing the award of “Good.”

A rating may also be deprived of a Good Service Badge or badges by the Director and Registrar of Naval Reserves for an offence under Article 53 or on re-enrolment if he has committed an offence during temporary service in the Naval Forces.

Restoration.—One forfeited badge may be restored by the Commanding Officer of the ship or establishment concerned on the satisfactory completion of the next period of training with “V.G.” character; or, should the Reservist be mobilized in the meantime, on the completion of six months’ mobilized service with “V.G.” character. A badge forfeited during mobilized service may be restored after six months of such service, with “V.G.” character, from the date of deprivation.

The satisfactory completion of one further period of training with “V.G.” character, or a further six months’ mobilized service, as the case may be, is required for the restoration of each additional badge.

Service Certificate N.Z. Navy R. 1.—All awards, deprivations, and restorations of badges are to be noted on service certificates, N.Z. Navy R. 1, in the space provided for Notations of Training (not in the space for Good Conduct Badges) and on Form. N.Z.D R. 8.

Description of Badges.—Badges are similar in design to the Royal Navy Good Conduct Badge, but the width of the stripe is ⅛ in. only.

Wearing of Badges.—Badges are to be worn on the left arm, in the same manner as Royal Naval Good Conduct Badges. When more than one Good Service Badge is worn the distance between them is to be ⅛ in., measured perpendicularly.

Ratings entitled to wear Good Conduct Badges may also wear Good Service Badges in conjunction with them, but the combined number must not exceed three. Good Conduct Badges are to be worn superior to Good Service Badges, the distance between the lower Good Conduct Badge and the higher Good Service Badge being half an inch measured perpendicularly.

Chief Petty Officers will not wear Good Service Badges.
