“Owner,” in relation to any electric line or work, includes any person using or operating the electric line or work, or acting or apparently acting in the general management and control thereof; and, in relation to any electric materials, includes any person having the materials in his possession or control or on order by him.

REGULATION 2.—ELECTRICITY CONTROLLER.

(1) The Minister may from time to time appoint a Controller be known as “the Electricity Controller.”

(2) The Controller shall hold office during the pleasure of the Minister.

(3) The general functions of the Controller shall be to promote, organize, and control the supply of electric power, and to promote, organize, and control other industries and trades so far as they may affect the supply of electric power and are not within the jurisdiction of any other Controller appointed under the principal regulations.

(4) The Controller shall be subject in all things to the control of the Minister and shall act in accordance with all directions, general or special, given to him by the Minister.

REGULATION 3.—POWERS OF ELECTRICITY CONTROLLER.

(1) The Controller shall have all such powers, privileges, and rights, including the right of access to any premises, as may to the Controller appear necessary to enable him to carry out his functions, and in particular shall have—

(a) Absolute control of the generation, transmission, distribution, sale, and use of electric energy throughout New Zealand, with the right from time to time or at any time as he may deem fit to end or diminish or refuse to authorize, either for a fixed period or for an indefinite period, the supply of electrical energy, whether publicly or privately owned, to any electrical supply authority or to any consumer, or to supply authorities or to consumers generally, or generally within any area or areas specified by him in that behalf; and such control shall apply to all publicly or privately owned generating-plants:

(b) Authority to lay, construct, put up, place, and use such electric lines or works as he may think fit, without license or authority other than these regulations and without complying with the Electrical Supply Regulations 1935, the Electric Wiring Regulations 1935, the Water-power Regulations 1934, or any regulation or Order in Council under the Tramways Act, 1928, the Coal-mines Act, 1925, the Mining Act, 1926, or any restrictive provision in the Electrical Wiremen’s Registration Act, 1925, or any other Act other than the Public Safety Conservation Act, 1932; and, without restricting the powers hereby conferred, he shall in respect of every such electric line or work have all the rights, powers, and privileges conferred upon or enjoyed by the Minister of Public Works in respect of an electric line or work erected under section 311 of the Public Works Act, 1928, or conferred upon or enjoyed by an Electric-power Board or Municipal Corporation in respect of an electric line or work erected or used under section 319 of the Public Works Act, 1928.
