day of December, one thousand nine hundred and thirty-eight (the portion of road affected by such resolution being shown by red colour on the plan mentioned in the Schedule hereto), viz. :
"The Taieri County Council, being the local authority having control of the roads in the County of Taieri, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of road adjoining Allotments 16, 17, and 18, Plan 1224, being parts of Sections 8, 47, and 54, Block VI, Maungatua";
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of road (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of road.
SCHEDULE.
The south-eastern side of all that portion of road in the Otago Land District, County of Taieri, fronting part Lot 16 and Lots 17 and 18, D.P. 1224, being parts Sections 8, 47, and 54, Block VI, Maungatua Survey District. As the same is more particularly delineated on the plan marked P.W.D. 101859, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Portion of Road in the County of Taieri, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government House at Wellington, this 14th day of February, 1939.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Taieri County Council on the twenty-ninth day of October, one thousand nine hundred and thirty-eight, viz. :
"The Taieri County Council, being the local authority having control of the roads in the County of Taieri, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of road adjoining part of Section 18, Irregular Block, East Taieri Survey District";
(the portion of road affected by such resolution being coloured red on the plan referred to in the Schedule hereto); subject to the condition that no building or part of a building shall at any time be erected on the land fronting the western side of the portion of road (described in the Schedule hereto), within a distance of thirty-three feet from the centre-line of the said portion of road.
SCHEDULE.
The western side of all that portion of road in the Otago Land District, County of Taieri, fronting part Section 18, Irregular Block, East Taieri Survey District. As the same is more particularly delineated on the plan marked P.W.D. 101297, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Amending Order in Council dated 24th June, 1919, licensing George Hunter Neill to Occupy Land between High- and Low-water Marks in the Manapouri River, Hokitika Harbour, and to Reclaim such Land.

ORDER IN COUNCIL.
At the Government House at Wellington, this 14th day of February, 1939.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by Order in Council dated the twenty-fourth day of June, one thousand nine hundred and nineteen, and published in the Gazette of the twenty-sixth day of the same month, at page 1916, George Hunter Neill was licensed to occupy a part of the land between high- and low-water marks in the Manapouri River, Hokitika Harbour, and to reclaim such land ;
And whereas it is desirable to amend the said Order in Council :
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers and authorities conferred upon him by the Harbours Act, 1923, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby amend, as from the first day of April, one thousand nine hundred and thirty-nine, the hereinbefore-recited Order in Council by revoking in clause 1 of the conditions thereto the symbol and figures “£1 10s.” and substituting the figures and letter “18s.”

Revoking Order in Council of 21st October, 1935, Licensing A. W. Bryant Ltd., of Auckland, to Occupy a Part of the Land below Low-water Mark at Whangapoua, for the purpose of taking Sand.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by Order in Council dated the twenty-first day of October, one thousand nine hundred and thirty-five, and published in the Gazette of the twenty-fourth day of the same month, at page 2944, A. W. Bryant Ltd., of Auckland, was licensed to occupy a part of the land below low-water mark at Whangapoua, for the purpose of taking away the sand deposited thereon ;
And whereas it is desirable to revoke the said Order in Council of the twenty-first day of October, one thousand nine hundred and thirty-five :
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority vested in him by the Harbours Act, 1923, and of all other powers and authorities enabling him in that behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby revoke the hereinbefore-recited Order in Council of the twenty-first day of October, one thousand nine hundred and thirty-five, as from the first day of April, one thousand nine hundred and thirty-eight.
