Authorizing the Laying-off of a Street (Kensington Avenue
Extension) in the City of Christchurch of a Width less than
66ft., but not less than 50ft., subject to a Condition as to the
Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 14th day of
February, 1939.
Present:
His Excellency THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers vested in him by
the Municipal Corporations Act, 1933, the Public Works
Act, 1928, and of all other powers in anywise enabling him
in this behalf, His Excellency the Governor-General of the
Dominion of New Zealand, acting by and with the advice
and consent of the Executive Council of the said Dominion,
doth hereby authorize the Christchurch City Council to permit
the laying-off of the proposed street described in the Schedule
hereto of a width less than sixty-six feet, but not less than
fifty feet, subject to the condition that no building or part
of a building shall at any time be erected on Lots 5-26 (both
inclusive) shown on Plan P.W.D. 100115, mentioned in the
Schedule hereto, within a distance of forty-eight feet from the
centre-line of the said street, or on Lots 2 and 3, shown on such
plan, within a distance of thirty-five feet from the centre-line
of the said street.
SCHEDULE.
That proposed street in the Canterbury Land District, City
of Christchurch, containing by admeasurement 3 roods 21'9
perches, more or less, being portion of Lot 5, D.P. 1122, being
part Rural Section 345. As the same is more particularly
delineated on the plan marked P.W.D. 100115, deposited in
the office of the Minister of Public Works at Wellington, and
thereon coloured red.

Portion of Tory Street, in the City of Nelson, exempted from
the Provisions of Section 128 of the Public Works Act, 1928,
subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 14th day of
February, 1939.
Present:
His Excellency THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of all other powers in
anywise enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the following
resolution passed by the Nelson City Council, viz.:-
"The Nelson City Council, being the local authority
having control of the streets of the City of Nelson, by
resolution passed this twentieth day of December, one
thousand nine hundred and thirty-eight, declares that the
provisions of section one hundred and twenty-eight of the
Public Works Act, 1928, shall not apply to the eastern
side of Tory Street on the western side of part Section
359, City of Nelson, marked A-B and coloured red on
plan";
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the eastern
side of the portion of Tory Street (described in the Schedule
hereto), within a distance of thirty-three feet from the centre-
line of the said portion of street.
SCHEDULE.
The eastern side of all that portion of street, situated in the
Nelson Land District, City of Nelson, known as Tory Street,
fronting part Section 359, City of Nelson. As the same is
more particularly delineated on the plan marked P.W.D.
101850, deposited in the office of the Minister of Public Works
at Wellington, and thereon coloured red.

Portions of Stewart Street, in the Borough of Mount Eden,
exempted from the Provisions of Section 128 of the Public
Works Act, 1928, subject to a Condition as to the Building-
line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 14th day of
February, 1939.
Present:
His Excellency THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of all other powers in any-
wise enabling him in this behalf, His Excellency the Governor-
General of the Dominion of New Zealand, acting by and with
the advice and consent of the Executive Council of the said
Dominion, doth hereby approve of the following resolution
passed by the Mount Eden Borough Council on the thirty-
first day of May, one thousand nine hundred and thirty-
eight, viz.:-
"That this Council declares that the provisions of section
one hundred and twenty-eight of the Public Works Act,
1928, shall not apply to that portion of Stewart Street
fronting portion of Lot 8, Section 6, Suburbs of Auckland,
as more particularly delineated on the accompanying
plans";
(the portion of street affected by such resolution being shown
by red colour on the plan mentioned in the Schedule hereto);
subject to the condition that no building or part of a
building shall at any time be erected on the land fronting
the northern and southern sides of the portions of Stewart
Street (described in the Schedule hereto), within a distance
of thirty-three feet from the centre-lines of the said portions
of street.
SCHEDULE.
The northern side of all that portion of street, situated in
the North Auckland Land District, Borough of Mount Eden,
known as Stewart Street, fronting part Lot 40, Deeds Plan 37
(blue), being part Allotment 8 of Section 6, Suburbs of
Auckland.
Also the southern side of all that portion of the said street
fronting part Lot 41, Deeds Plan 21 (blue), being part
Allotment 8 of Section 6, Suburbs of Auckland.
As the same are more particularly delineated on the plan
marked P.W.D. 99717, deposited in the office of the Minister
of Public Works at Wellington, and thereon coloured red.

from the Provisions of Section 128 of the Public Works Act,
1928, subject to a Condition as to the Building-line.

His Excellency THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of all other powers in
anywise enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the following
resolution passed by the Christchurch City Council on the
seventh day of November, one thousand nine hundred and
thirty-eight (the portion of street affected by such resolution
being shown by yellow colour on the plan mentioned in the
Schedule hereto), viz.:-
"The Christchurch City Council, being the local authority
having control of the streets in the City of Christchurch,
by resolution declares that the provisions of section one
hundred and twenty-eight of the Public Works Act, 1928,
shall not apply to that portion of street known as Okeover
Street, adjoining part R.S. 101, Certificate of Title,
Volume 28, folio 151";
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the south-
eastern side of the portion of Okeover Street (described in
the Schedule hereto), within a distance of thirty-five feet
from the centre-line of the said portion of street.
