Domain Board appointed to have Control of the Whenuanui Domain.

GALWAY, Governor-General.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 30th day of January, 1939.

Present:

THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by section forty-four of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

George Biggar,
Frederick Phillip Sander,
Samuel David Llewellyn,
Kenneth Robert Gundersen,
Ollie Arnold Blong,
George Andrew Scott,
Oswald Whitcombe,
Benjamin Allan Wood, and
Everard Douglas Wynne Wright

to be the Whenuanui Domain Board, having control of the land described in the Schedule hereto; and doth hereby appoint Thursday, the twenty-sixth day of January, one thousand nine hundred and thirty-nine, at eight o’clock p.m., as the time when, and the Whenuanui Hall as the place where, the first meeting of the Board shall be held.

SCHEDULE.

NORTH AUCKLAND LAND DISTRICT.—WHENUANUI DOMAIN.
ALL those areas in Otamatea County containing by admeasurement a total area of 136 acres 2 roods 9 perches, more or less, more particularly described as follows:

All that area containing by admeasurement 11 acres 1 rood 22 perches, more or less, being part of Section 2, Block XII, Tokatoka Survey District; bounded towards the west generally by a public road adjoining the generally eastern boundary of Section 28, Block XI, Tokatoka Survey District; towards the north-east generally by a public road adjoining the generally southern boundary of Lot 2 on D.P. 26906; and towards the south-east generally by a public road passing through the aforesaid Section 2.

Also all that area containing by admeasurement 124 acres 3 roods 27 perches, more or less, being part of Section 2, Block XII, Tokatoka Survey District; bounded towards the north-east generally by a public road adjoining the generally south-western boundary of Lot 4 on D.P. 26906; towards the south-east generally by Section 23 of aforesaid Block XII; towards the south-west generally by a canal reserve and Sections 25 and 3 of aforesaid Block XII; toward the west generally by a public road adjoining the generally eastern boundary of Section 85, Block XI, Tokatoka Survey District; and towards the north-west generally by a public road passing through the aforesaid Section 2.

Also all that area containing by admeasurement 1 rood, more or less, being part of Section 27, Block XII, Tokatoka Survey District, and being all the land contained in Certificate of Title, Volume 659, folio 188, Auckland Registry.

As the same are more particularly delineated on the plan marked L. and S. 1/744A, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red. (North Auckland plans S.O. 20777 and 20889.)

Consenting to the Raising of Loans by certain Local Authorities and prescribing the Conditions thereof.

GALWAY, Governor-General.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 2nd day of February, 1939.

Present:

THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.

WHEREAS the several local authorities enumerated in the Schedule hereto, being desirous of raising the respective loans stated opposite their names therein, have respectively complied with the provisions of the Local Government Loans Board Act, 1926 (hereinafter called “the said Act”), and it is expedient that the precedent consent of the Governor-General in Council, as required by the said Act, should be given to the raising of the said loans:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the said Act, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising in New Zealand by the respective local authorities mentioned in the First Column of the said Schedule of the respective loans set out in the Second Column of the said Schedule, up to the respective amounts specified in the Third Column of the said Schedule, and in giving such consent doth hereby determine as follows:—

(1) The terms for which the said loans or any parts thereof may be raised shall be the respective terms (in years) stated in the Fourth Column of the said Schedule.

(2) The rates of interest that may be paid in respect of the said loans or any parts thereof shall be such as shall not produce to the lender or lenders a rate or rates exceeding the respective rates per centum per annum stated in the Fifth Column of the said Schedule.

(3) The said respective loans or any parts thereof, together with interest thereon, shall be repaid by equal aggregate annual or half-yearly instalments extending over the respective terms as determined in (1) above.

(4) The payment of such instalments shall be made in New Zealand, and no such instalment shall be paid out of loan-moneys.

(5) The rate payable for brokerage, underwriting, and procurement fees in respect of the raising of the said respective loans or any parts thereof shall not in the aggregate exceed one-half per centum of any amount raised.

(6) No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.
