Varying the Determinations in respect of Loans or Portions thereof being raised by certain Local Authorities.

ORDER IN COUNCIL.

At the Government House at Wellington, this 16th day of August, 1939.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by Orders in Council made on the respective dates specified in the Third Column of the Schedule hereto, consent was given to the raising by the respective local authorities enumerated in the First Column of the said Schedule of the respective loans stated in the Second Column of the said Schedule, subject in each case to the determinations set forth in such Orders in Council:

And whereas in respect of the amount of each such loan the sum specified in the Fourth Column of the said Schedule opposite such loan (hereinafter referred to as “the said sum”) has not yet been raised, and it is expedient to vary the determinations in respect of each such loan in so far as such determinations apply to the raising of the said sum:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby in respect of each loan referred to in the Schedule hereto vary certain of the aforesaid determinations in respect of the raising of such loan in so far as such determinations apply to the raising of the said sum by prescribing that in lieu of the rate of interest of three pounds ten shillings (£3 10s.) per centum per annum specified in the Order in Council authorizing the raising of such loan the rate of interest that may be paid in respect of the said sum shall be such as shall not produce to the lender or lenders a rate exceeding four pounds five shillings (£4 5s.) per centum per annum.

Revoking the Declaration of Main Highways and declaring Public Highways to be Main Highways.

ORDER IN COUNCIL.

At the Government House at Wellington, this 9th day of August, 1939.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers and authorities vested in him by section three of the Main Highways Act, 1922, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that on and after the date of publication of this Order in Council in the Gazette the portions of main highways described in the First Schedule hereto shall cease to be main highways, and doth further declare that the roads described in the Second Schedule hereto shall be main highways within the meaning and for the purposes of the Main Highways Act, 1922.

FIRST SCHEDULE.

HIGHWAY DISTRICT No. 2.

Hobsonville Highway.—All that main highway in Waitemata County, declared as the Hobsonville Highway, described in Order in Council dated 13th November, 1934, and published in the Gazette on 15th November, 1934.

HIGHWAY DISTRICT No. 9.

Wellington—Auckland via Taranaki.—All that portion of highway in the Manawatu County, commencing on the right bank of the Manawatu River at the south-western corner of part Section 429, Block IX, Mount Robinson Survey District, and proceeding thence generally in a northerly, north-westerly, then northerly direction and terminating near the south-eastern corner of Lot 4, D.P. 3002, Block V, Mount Robinson Survey District, being a distance of 1 mile 50 chains, more or less; as the same is more particularly delineated on plan P.W.D. No. 103358, deposited in the office of the Main Highways Board at Wellington, and thereon coloured yellow.

Also all that portion of highway in the Manawatu County and Foxton Borough, commencing at a point opposite part Paretão Block, Block V, Mount Robinson Survey District, and proceeding thence generally in a northerly then north-westerly direction and terminating at the southern boundary of the Borough of Foxton, at the junction of Johnstone and Purcell Streets, being a distance of 29 chains more or less; as the same is more particularly delineated on plan P.W.D. No. 103358, deposited in the office of the Main Highways Board at Wellington, and thereon coloured yellow.

HIGHWAY DISTRICT No. 10.

Wellington—Napier via Wairarapa.—All that portion of main highway in the Borough of Featherston, commencing at a point opposite part Section 2, Block III, Wairarapa Survey District, and proceeding thence generally in a south-easterly, then north-easterly direction via Brandon and Moore Streets and terminating at the junction of Moore and Ludlam Streets, being a distance of 21 chains, more or less; as the same is more particularly delineated on plan P.W.D. No. 103785, deposited in the office of the Main Highways Board at Wellington, and thereon coloured yellow and blue.

Wellington—Napier via Wairarapa.—All that portion of main highway in the Masterton County commencing in part Section 6, Opaki Registration District, Block XIII, Kopuaranga Survey District, and proceeding thence generally in a northerly direction and terminating in part Section 7, Opaki Registration District, Block XIII, Kopuaranga Survey District, being a distance of 14 chains, more or less; as the same is more particularly delineated on plan P.W.D. No. 103789, deposited in the office of the Main Highways Board at Wellington, and thereon coloured yellow.
