Conferring on Southland County Council certain Powers of Borough Councils with respect to Drainage and Sanitation.

ORDER IN COUNCIL.
At the Government House at Wellington, this 5th day of July, 1939.

His Excellency the Governor-General in Council.
IN pursuance and exercise of the power and authority vested in him in that behalf by section one hundred and eighty-two of the Counties Act, 1920, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby confer on the Southland County Council all the powers with respect to drainage and sanitation exercisable by a duly constituted Borough Council under section ninety-one, Part XIX, and section three hundred and forty-six of the Municipal Corporations Act, 1933, but subject to the restriction that such powers shall be exercisable only over that portion of the County of Southland described in the Schedule hereto.
SCHEDULE.
All that area of land situated in Block I, Invercargill Hundred, being part of the Town of Hawthorndale and comprising the whole of Blocks I and II of the said Town of Hawthorndale; and also Lots 1 to 26 (inclusive), 28, 30, 32, 34, 36, 38, and 40, Block III, of the said town; and also Lots 1, 2, 6, 8, 10, 12, 14, 16, 18, 20, 22, and 24, Block IV, of the said town; and also Lots 1 to 6 (inclusive), Block V, of the said town.

Consenting to Additional Land being taken for the Purposes of a Secondary School in Block I, Oamaru Survey District.

At the Government House at Wellington, this 28th day of June, 1939.

His Excellency the Governor-General in Council.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby consent to the additional land described in the Schedule hereto being taken for the purposes of a secondary school.
SCHEDULE.
APPROXIMATE area of the piece of land permitted to be taken: 19 acres l rood 26 perches.
Being portion of Section 13, Block I, Oamaru Survey District (Otago R.D.). (S.O. 9110.)
In the Otago Land District; as the same is more particularly delineated on the plan marked P.W.D. 102882, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Consenting to the Raising of a Loan of £1,139 by the Castlepoint County Council and prescribing the Conditions thereof.

ORDER IN COUNCIL.
At the Government House at Wellington, this 28th day of June, 1939.

His Excellency the Governor-General in Council.
WHEREAS the Castlepoint County Council (hereinafter called "the said local authority") proposes, pursuant to the provisions of section three of the Main Highways Amendment Act, 1928, to borrow the sum of one thousand one hundred and thirty-nine pounds (£1,139) by a loan to be known as "Main Highways Loan, 1939" (hereinafter called "the said loan"), for the purpose of paying its portion of the cost of renewing three bridges on the Masterton-Castlepoint Main Highway;
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising by the said local authority of the said loan for the said purpose up to the amount of one thousand one hundred and thirty-nine pounds (£1,139), and in giving such consent doth hereby determine as follows:
(1) The term for which the said loan or any part thereof may be raised shall be five (5) years.
(2) The rate of interest that may be paid in respect of the said loan or any part thereof shall be such as shall not produce to the lender or lenders a rate exceeding three pounds ten shillings (£3 10s.) per centum per annum.
(3) The said loan, together with interest thereon, shall be repaid by equal aggregate annual instalments extending over the term as determined in (1) above.
(4) No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.

Consenting to the Raising of a Loan of £600 by the Castlepoint County Council and prescribing the Conditions thereof.

ORDER IN COUNCIL.
At the Government House at Wellington, this 28th day of June, 1939.
Present:
His Excellency the Governor-General in Council.
WHEREAS by Order in Council made on the seventh day of May, one thousand nine hundred and thirty-seven, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising by the Castlepoint County Council (hereinafter called "the said local authority") of the sum of six hundred pounds (£600) by a loan to be known as "Worker's Dwelling Loan, 1937" (hereinafter called "the said loan"):
And whereas the authority conferred by the said Order in Council has not been exercised:
And whereas the authority has lapsed in accordance with the provisions of clause six thereof and it is not now lawful or competent for the said local authority to raise the said loan except in accordance with the provisions of a further Order in Council that may be issued pursuant to section eleven of the Local Government Loans Board Act, 1926 (hereinafter called "the said Act"):
And whereas it is expedient to authorize the said local authority to raise the said loan on the conditions hereinafter mentioned:
Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the said Act, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the raising in New Zealand by the said local authority of the said loan up to the amount of six hundred pounds (£600), and in giving such consent doth hereby determine as follows:
(1) The term for which the said loan or any part thereof may be raised shall not exceed twenty (20) years.
(2) The rate of interest that may be paid in respect of the said loan or any part thereof shall be such as shall not produce to the lender or lenders a rate exceeding four pounds five shillings (£4 5s.) per centum per annum.
(3) The said loan or any part thereof together with interest thereon shall be repaid by equal aggregate annual or half-yearly instalments extending over the term as determined in (1) above.
(4) The payment of such instalments shall be made in New Zealand and no instalments shall be paid out of loan-moneys.
(5) The rate payable for brokerage, underwriting, and procurement fees in respect of the raising of the said loan or any part thereof shall not in the aggregate exceed one-half per centum of any amount raised.
(6) No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.
