Portion of Pennant Street, in the City of Dunedin, exempted
from the Provisions of Section 128 of the Public Works Act,
1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government House at Wellington, this 28th day of
June, 1939.
Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of all other powers in
anywise enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council
of the said Dominion, doth hereby approve of the following
resolution passed by the Dunedin City Council on the seventh
day of April, one thousand nine hundred and thirty-nine, viz.:-
“That the Dunedin City Council, being the local
authority having control of the streets in the City of
Dunedin, by resolution declares that the provisions of
section one hundred and twenty-eight of The Public
Works Act, 1928, shall not apply to the south-eastern
side of portion of Pennant Street abutting on Lot A
and R.O.W., L.T.P. 1012, Township of Broughton”;
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the south-
eastern side of the portion of Pennant Street (described in
the Schedule hereto) within a distance of thirty-three feet
from the centre-line of the said portion of street.
SCHEDULE.
THE south-eastern side of all that portion of street, situated
in the Otago Land District, City of Dunedin, known as
Pennant Street, fronting Lot A and right-of-way on D.P.
1012, Township of Broughton, being part Sections 17 and
121R, Block IV, Upper Kaikorai District. As the same is
more particularly delineated on the plan marked P.W.D.
103058, deposited in the office of the Minister of Public
Works at Wellington, and thereon coloured red.

Nelson, exempted from the Provisions of Section 128 of the
Public Works Act, 1928, subject to a Condition as to the
Building-line.

IN pursuance and exercise of the powers conferred by the
Public Works Act, 1928, and of all other powers in
anywise enabling him in this behalf, His Excellency the
Governor-General of the Dominion of New Zealand, acting
by and with the advice and consent of the Executive Council

resolution passed by the Nelson City Council on the sixteenth
day of March, one thousand nine hundred and thirty-nine,
viz. :-
“The Nelson City Council, being the local authority
having control of the streets of the City of Nelson, by
resolution declares that the provisions of section one
hundred and twenty-eight of the Public Works Act,
1928, shall not apply to the western side of Church
Street on the eastern side of part Section 446, City of
Nelson, marked A-B, and coloured red on plan”;
subject to the condition that no building or part of a building
shall at any time be erected on the land fronting the western
side of the portion of Church Street (described in the
Schedule hereto) within a distance of thirty-three feet from
the centre-line of the said portion of street.
SCHEDULE.
THE western side of all that portion of street, situated in the
Nelson Land District, City of Nelson, known as Church
Street, fronting part Lot 2, D.P. 1393, being part Section 446,
City of Nelson. As the said portion of street is more par-
ticularly delineated on the plan marked P.W.D. 102672,
deposited in the office of the Minister of Public Works at
Wellington, and thereon coloured red.

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.
WHEREAS by Order in Council made on the twenty-
second day of June, one thousand nine hundred and
thirty-eight, consent was given to the raising in New Zealand
by the Buller County Council (hereinafter called “ the said
local authority”) of the sum of fourteen thousand pounds
(£14,000) by a loan to be known as “ Road Improvements
Loan, 1938” (hereinafter called “ the said loan”), such
consent being given subject to the determinations as to
borrowing and repayment therein set out (including, inter
alia, the provision that the rate of interest that might be
paid in respect of the said loan or any part thereof should
be such as should not produce to the lender or lenders a rate
or rates exceeding three pounds ten shillings (£3 10s.) per
centum per annum):
