Withdrawing Land from the Operation of the Kauri-gum Industry Act, 1908.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 24th day of May, 1939.

WHEREAS by section one hundred and sixty-two of the Land Act, 1924, it is enacted that the Governor-General may, by Order in Council, on the recommendation of the Land Board, declare that any land comprised in a kauri-gum reserve shall, from a date to be specified in the Order, cease to be subject to the Kauri-gum Industry Act, 1908, and on and after the date so specified the land to which the Order relates shall become subject to the provisions of the Land Act, 1924:
And whereas the Land Board of the North Auckland Land District has duly passed resolutions recommending that the portion of the Opoe Kauri-gum Reserve Extension No. 2, as described in the Schedule hereto, be excepted from the operations of the Kauri-gum Industry Act, 1908, and it is expedient to give effect to such recommendation:
Now, therefore, I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, in pursuance and exercise of the power and authority conferred upon me by section one hundred and sixty-two of the Land Act, 1924, and acting by and with the advice and consent of the Executive Council of the said Dominion, do hereby order and declare that the portion of the Opoe Kauri-gum Reserve Extension No. 2, as described in the Schedule hereto, shall, from the first day of June, one thousand nine hundred and thirty-nine, cease to be subject to the Kauri-gum Industry Act, 1908.
SCHEDULE.
NORTH AUCKLAND LAND DISTRICT.
All those areas in Mangonui County containing by admeasurement a total area of 69 acres 2 roods 1.1 perches, more or less, situated in Blocks IV and V, Opoe Survey District, being parts of Opoe Kauri-gum Reserve Extension No. 2, and more particularly described as follows:—
All that area containing by admeasurement 69 acres 0 roods 12.1 perches, more or less; bounded, commencing at the northernmost corner of Section 67, Block V, Opoe Survey District; thence towards the south-east generally by another part of Opoe Kauri-gum Reserve Extension No. 2, following right lines, bearing 62° 38', 1786-7 links, 52° 40', 2733-4 links, 28° 49', 554-5 links; thence towards the north-east generally by a public road, a closed road, again a public road, and again a closed road for a distance of 89-4 links; thence towards the north-west generally by another part of Opoe Kauri-gum Reserve Extension No. 2 following right lines bearing 261° 49', 1514-9 links, 261° 36', 554-3 links; thence again towards the north-west generally by Section 15, Block IV, Opoe Survey District; be all the aforesaid measurements more or less.
Also all that area containing by admeasurement 1 rood 15-4 perches, more or less, bounded towards the north-east generally by a closed road adjoining Section 6, Block IV, Opoe Survey District, and towards the south-west generally by a public road.
Also all that area containing by admeasurement 13-6 perches, more or less, bounded towards the north-east generally by a closed road adjoining Section 1, Block IV, Opoe Survey District, and towards the south-west generally by a public road.
As the same are more particularly delineated on the plan marked L and S. 9/2155A, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red. (North Auckland plans S.O. 28799 and 28253.)

PURSUANT to the authority conferred upon me by the three-hundred-and-first section of the Justices of the Peace Act, 1927, I, George Vere Arundell, Viscount Galway, the Governor-General of the Dominion of New Zealand, do hereby notify and declare that the persons whose names are set out in the Schedule hereto, being officers in the service of the Crown holding the offices stated opposite their names respectively in the said Schedule, are authorized to take and receive statutory declarations under the three-hundred-and-first section of the Justices of the Peace Act, 1927.
