Portions of Rangiruru Road (Kauparaha Street), in the Borough of Otaki, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government Buildings at Wellington, this 2nd day of May, 1939.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Otaki Borough Council on the twenty-eighth day of March, one thousand nine hundred and thirty-nine (the portions of street affected by such resolution being more particularly described in the Schedule hereto), viz.:
“That the Otaki Borough Council, being the local authority having control of the streets in the Borough of Otaki, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that part of Rangiruru Road, Otaki (shown on the undermentioned Certificate of Title as Kauparaha Street, Otaki), upon which abuts that piece of land containing one acre one rood twenty-four and two-tenths perches (1 acre 1 rood 24·2 perches) being part of Otaki A No. 59s and being also Lot 2 on Deposited Plan No. 7988, and being all the land comprised and described in certificate of title, Vol. 353, folio 69, Wellington Register”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western side of the portions of Rangiruru Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said street.
SCHEDULE.
THE north-western side of all those portions of street situated in the Wellington Land District, Borough of Otaki, known as Rangiruru Road, fronting Lot 2, D.P. 7938, being part Otaki A No. 59s Block. As the same are more particularly delineated on the plan marked P.W.D. 102915, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.

Vesting the Control of a Scenic Reserve in the Matamata County Council.
GALWAY, Governor-General.
IN pursuance and exercise of the powers and authorities conferred upon him by section thirteen of the Scenery Preservation Act, 1908 (hereinafter referred to as “the said Act”), His Excellency the Governor-General of the Dominion of New Zealand doth hereby vest the control of the scenic reserve described in the Schedule hereto (being land reserved under the said Act) in the Matamata County Council, subject to the conditions hereinafter contained, that is to say :—

The period for which the control of the reserve is hereby vested shall be five years from the date hereof, unless the reservation is previously altered or revoked under the said Act.

The said Council shall prepare a report each year ending on the thirty-first day of March, together with a statement of receipts and expenditure in connection with the said reserve. Such report and statement shall be sent to the Minister charged with the administration of the said Act as soon as possible after the close of the year.

The said Council shall control the said reserve in accordance with the provisions of the said Act and of the regulations made thereunder.
SCHEDULE.
MAUNGATAUTARI MOUNTAIN SCENIC RESERVE.—AUCKLAND LAND DISTRICT.
ALL that area containing by admeasurement 2,691 acres 2 roods, more or less, being Maungatautari No. 3A Section 5A No. 7 Block, Maungatautari Survey District, and being all the land comprised in certificate of title, Vol. 201, folio 102, Auckland Registry.
Also all that area containing by admeasurement 936 acres 2 roods, more or less, being Maungatautari No. 3A Section 5A No. 3 Block, Maungatautari Survey District, and being all the land comprised in certificate of title, Vol. 235, folio 20, Auckland Registry.
Also all that area containing by admeasurement 221 acres, more or less, being Maungatautari No. 3A Section 5A No. 6 Block, and being all the land comprised in certificate of title, Vol. 275, folio 133, Auckland Registry.
As witness the hand of His Excellency the Governor-General, this 3rd day of May, 1939.
