Portions of Tay Street, in the Borough of Oamaru, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 15th day of March, 1939.
Present:
THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.
IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Oamaru Borough Council on the twenty-fourth day of November, one thousand nine hundred and thirty-eight, viz.:
“ That the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that part of the north-western side of Tay Street abutting—
(a) On Allotment 24, on a plan of part of the Township of Newburgh, deposited in the Land Registry Office at Dunedin as number 1630 (Allotment 24 being included in certificates of title, Vol. 218, folio 123 and Vol. 210, folio 123);
(b) On Allotment 26, shown on the said deposited plan, and included in certificate of title, Vol. 220, folio 79;
(c) On that half of Allotment 25, shown on the said deposited plan, adjoining said Allotment 24, and included in certificate of title, Vol. 187, folio 69 ”;
subject to the condition that no building or part of a building shall at any time be erected on the land fronting the north-western side of the portions of Tay Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said portions of street.
SCHEDULE.
THE north-western side of all that portion of street, situated in the Otago Land District, Borough of Oamaru, known as Tay Street, fronting Allotment 24 and part Allotment 25, D.P. 1630, Township of Newburgh.
Also the north-western side of all that portion of street, situated in the said land district and borough, known as Tay Street, fronting Allotment 26, D.P. 1630, Township of Newburgh.
As the same are more particularly delineated on the plan marked P.W.D. 102441, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.

Revocation of Order in Council setting apart Native Land as a Native Reservation.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 15th day of March, 1939.

THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.
PURSUANT to subsection 4 of section 5 of the Native Purposes Act, 1937, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby revoke the Order in Council made on the twenty-seventh day of July, one thousand nine hundred and thirty-eight, and published in the Gazette on the fourth day of August, one thousand nine hundred and thirty-eight, at page 1771, setting apart and reserving Kaipakopako 4A No. 1B Block as a Native Reservation for the common use of Ngati-Rahiri and other tribes as a meeting-place.

PURSUANT to section 5 of the Native Purposes Act, 1937, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby set apart and reserve the Native freehold land described in the first part of the Schedule hereto as a Native Reservation for the common use of the Native tribes set out in the second part of the said Schedule as a meeting-place.

Temporarily appointing a Chairman of the Wellington Tramways Appeal Board.
GALWAY, Governor-General.
WHEREAS it is provided in clause twelve of the regulations under the Tramways Amendment Act, 1910, made on the second day of February, one thousand nine hundred and eleven, that in the case of the unavoidable absence of the Chairman of the Board, the Governor-General shall appoint some other Magistrate to act as Chairman during such absence:
And whereas the Chairman of the Wellington Tramways Appeal Board is unavoidably absent and it is expedient that a temporary Chairman be appointed:
Now, therefore, I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, in pursuance of the powers and authorities conferred upon me by clause twelve of the said regulations and of all other powers in anywise enabling me in that behalf, do hereby appoint
John Hector Luxford, Esquire,
Stipendiary Magistrate, of Wellington, to act as Chairman of the Wellington Tramways Appeal Board, in the absence of the Chairman.
As witness the hand of His Excellency the Governor-General, this 17th day of March, 1939.
