Enabling the Supreme Court to exercise Jurisdiction in Prize.

A PROCLAMATION.
WHEREAS by section two of the Prize Courts Act, 1894 (Imperial),
it is enacted that any commission, warrant, or instructions from
Her Majesty the Queen or the Admiralty for the purpose of commissioning
or regulating the procedure of a Prize Court at any place in a British
possession may, notwithstanding the existence of peace, be issued at any
time with a direction that the Court shall act only upon such Proclamation
as is thereinafter mentioned being made in the possession :
And whereas by Warrant of the Commissioners for executing the Office
of Lord High Admiral of the United Kingdom given under the Seal of
the Office of Admiralty on the seventeenth day of August, one thousand
eight hundred and ninety-nine, the Chief Justice and all others the Judges
or Judge for the time being of the Supreme Court were authorized and
required from time to time upon any Proclamation being made by the
Vice-Admiral for the time being of New Zealand that war had broken out
between Her Majesty and any foreign state and not otherwise to take
cognizance of and judicially to proceed upon all and all manner of captures,
recaptures, seizures, prizes, and reprisals of all ships, vessels, and goods
which should on the outbreak of any such war have been already seized
and taken and which should thereafter be seized and taken and which
were or should be brought within the limits of the said Court and all other
matters of prize falling within the jurisdiction of the said Court :
And whereas by information received by me I am satisfied that war
has broken out as hereinafter proclaimed :
Now, therefore, in pursuance and exercise of the authority conferred
on me by the said Act, I, George Vere Arundell, Viscount Galway,
Governor-General and Vice-Admiral of the Dominion of New Zealand, do
hereby proclaim that war has broken out between His Majesty and
Germany to the intent that the jurisdiction in Prize of the Supreme
Court shall henceforth become exercisable.
Given under the hand of His Excellency the Governor-General of the
Dominion of New Zealand and Vice-Admiral of the same, and issued
under the Seal of that Dominion, this 23rd day of November, 1939.

Appointment of Officer of the Crown to conduct Prize Proceedings.

To the Honourable Mr. H. G. R. Mason, His Majesty’s Attorney-General for New Zealand.
PURSUANT to the authority vested in me by the Naval Prize Acts,
1864 (Imperial), and the Prize Court Rules made thereunder, and in
exercise of the powers and authorities vested in me as Vice-Admiral of
New Zealand, and of every other authority enabling me in this behalf,
I, George Vere Arundell, Viscount Galway, Governor-General of the
Dominion of New Zealand and Vice-Admiral of the same, do by these
presents issued under my hand and the Seal of the Dominion authorize and
appoint you, the said
Henry Greathead Rex Mason,
to be the Proper Officer of the Crown to conduct prize proceedings on
behalf of the Crown within the jurisdiction of the Supreme Court of
New Zealand, in the exercise of its jurisdiction as a Prize Court under the
said Naval Prize Acts, 1864 (Imperial).
Given under the hand of His Excellency the Governor-General of the
Dominion of New Zealand and Vice-Admiral of the same, and
issued under the Seal of that Dominion, this 23rd day of November,
1939.
