Consenting to the Borrowing of Moneys by the Rangitikei County Council by Way of Bank Overdraft.

GALWAY, Governor-General.
ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 29th day of November, 1939.

Present:
THE HON. W. NASH PRESIDING IN COUNCIL.

WHEREAS the Rangitikei County Council (hereinafter called “the said local authority”) being desirous of borrowing the sum of five thousand pounds (£5,000) by way of bank overdraft under the provisions of section seven of the Local Bodies Finance Act, 1921–22, by a loan to be known as “Flood Damage Restoration Loan, 1939” (hereinafter called “the said loan”), for the purpose of repairing flood damage throughout the county, has complied with the provisions of the Local Government Loans Board Act, 1926 (hereinafter called “the said Act”), and it is expedient that the precedent consent of the Governor-General in Council as required by the said Act should be given to the borrowing as aforesaid:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the said Act, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby consent to the borrowing of moneys by the said local authority under the said section seven for the said purpose up to the amount of five thousand pounds (£5,000) by way of bank overdraft, and in giving such consent doth hereby determine as follows:—
(1) Such borrowing may be from time to time by way of bank overdraft.
(2) The term for which the said loan or any part thereof may be borrowed shall not exceed seven (7) years.
(3) The rate of interest that may be paid in respect of the said loan or any part thereof shall not exceed current bank overdraft rates to best customers.
(4) The said loan shall be repaid by seven equal annual payments the first of which is to be made during the year ending the thirty-first day of March, one thousand nine hundred and forty-one.
(5) No amount payable as interest in respect of the said loan shall be paid out of loan-moneys.
(6) No moneys shall be borrowed under this consent after the expiration of two years from the date hereof.

Varying the Determinations in respect of the Dunedin Drainage and Sewerage Board’s Loan of £85,000.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 29th day of November, 1939.

Present:
THE HON. W. NASH PRESIDING IN COUNCIL.

WHEREAS by Order in Council made on the ninth day of June, one thousand nine hundred and thirty-nine, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising by the Dunedin Drainage and Sewerage Board (hereinafter called “the said local authority”) of the sum of eighty-five thousand pounds (£85,000) (hereinafter called “the said loan”):

And whereas the authority conferred by the said Order in Council has not yet been exercised and it is expedient to vary certain of the determinations aforesaid in respect of the said loan:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary certain of the determinations aforesaid in respect of the said loan by prescribing that in lieu of a term of twenty-nine (29) years as specified in clause one of the said Order in Council the term for which the said loan may be raised shall not exceed fifteen (15) years.

Varying the Determinations in respect of the Waipa County Council’s Loan of £2,000.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 29th day of November, 1939.

Present:
THE HON. W. NASH PRESIDING IN COUNCIL.

WHEREAS by Order in Council made on the twenty-first day of February, one thousand nine hundred and thirty-nine, and subject to the determinations as to borrowing and repayment therein set out, consent was given to the raising in New Zealand by the Waipa County Council (hereinafter called “the said local authority”) of the sum of two thousand pounds (£2,000) by a loan to be known as “Melville Water-supply Special Rating Area Loan, 1938” (hereinafter called “the said loan”):

And whereas the authority conferred by the said Order in Council has not yet been exercised and it is expedient to vary certain of the determinations aforesaid in respect of the said loan:

Now, therefore, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, and in pursuance and exercise of the powers and authorities conferred on him by section eleven of the Local Government Loans Board Act, 1926, as set out in section twenty-nine of the Finance Act, 1932 (No. 2), and of all other powers and authorities enabling him in this behalf, doth hereby vary certain of the determinations aforesaid in respect of the said loan by prescribing that in lieu of a rate of interest not exceeding three pounds ten shillings (£3 10s.) per centum per annum as specified in clause two of the said Order in Council the rate of interest that may be paid in respect of the said loan or any part thereof shall be such as shall not produce to the lender or lenders a rate exceeding four pounds five shillings (£4 5s.) per centum per annum.

Domain Board appointed to have Control of the Wanaka Islands Domain.

ORDER IN COUNCIL.

At the Government House at Wellington, this 7th day of December, 1939.

Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by section forty-four of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

John Faulks,
Willis Alan Scaife,
William Abraham Studholme,
Frederick Henry Ernest Collings,
Robert Cairns Walker,
David Charles Aubrey, and
Amos McKegg

to be the Wanaka Islands Domain Board, having control of the land described in the Schedule hereto; and doth hereby appoint Saturday, the sixth day of January, one thousand nine hundred and forty, at eight o’clock p.m., as the time when, and the Wanaka Public Hall as the place where, the first meeting of the Board shall be held.

SCHEDULE.

OTAGO LAND DISTRICT.—WANAKA ISLANDS DOMAIN.

ALL that area containing by admeasurement 300 acres, more or less, and known as Harwich Island, Lake Wanaka, bounded on all sides by Lake Wanaka.

Also all that area containing by admeasurement 290 acres, more or less, known as Crescent or Rabbit Island, Lake Wanaka, bounded on all sides by Lake Wanaka.

Also all that area containing by admeasurement 113 acres, more or less, being an island in Stevenson’s Arm, Lake Wanaka, bounded on all sides by Lake Wanaka.

Also all that area containing by admeasurement 7 acres 3 roods 10 perches, more or less, known as Ruby Island, in Lake Wanaka, situate about two miles from Pembroke.
