“ The Lake County Council, being the local authority having control of the roads in the County of Lake, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to portions of roads fronting Sections 29, 57, 30, 64, 65, 49, 31, 32, 50, 41, and 42, Block VI, Shotover Survey District ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the portions of roads (described in the Schedule hereto), within a distance of thirty-three feet from the centre-lines of the said portions of roads.

SCHEDULE.

THE northern side of all that portion of road, situated in the Otago Land District, County of Lake, fronting Sections 29, 57, and 30, Block VI, Shotover Survey District.

Also the western side of all those portions of road, situated in the said land district and county, fronting Sections 65, 31, and 50, Block VI, Shotover Survey District.

Also the eastern side of all that portion of road, situated in the said land district and county, fronting Sections 64, 49, and 32, Block VI, Shotover Survey District.

Also the south-western side of all those portions of road, situated in the said land district and county, fronting part Section 41 and Section 42, Block VI, Shotover Survey District.

Also the north-eastern side of all that portion of road, situated in the said land district and county, fronting part Section 41, Block VI, Shotover Survey District.

As the same are more particularly delineated on the plan marked P.W.D. 100057, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Warrant vesting the Control of Portions of the Great South Road in the Auckland City Council, the One Tree Hill Borough Council, the Ellerslie Town Board, and the Mount Wellington Road Board, respectively, and revoking former Warrants.

———

GALWAY, Governor-General.

IN pursuance and exercise of the powers and authorities vested in me by the Public Works Act, 1928, and of all other powers and authorities in anywise enabling me in this behalf, I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, do hereby proclaim and declare that on and after the date of the gazetting hereof, the portion of street described in the First Schedule hereto shall be under the control of and maintained by the Auckland City Council; that the portions of street described in the Second Schedule hereto shall be under the control of and maintained by the One Tree Hill Borough Council; that the portion of street described in the Third Schedule hereto shall be under the control of and maintained by the Ellerslie Town Board; and that the portion of street described in the Fourth Schedule hereto shall be under the control of and maintained by the Mount Wellington Road Board.

And I do hereby revoke the Warrants mentioned in the Fifth Schedule hereto.

FIRST SCHEDULE.

(To be under the control of and maintained by the Auckland City Council.)

ALL that portion of the Great South Road situated in the North Auckland Land District, One Tree Hill Borough, extending from Manukau Road to Cornwall Park Avenue, a distance of approximately 69 chains, being coloured pink on the plan hereinafter mentioned, and including the footpath and kerbing on both sides of the said portion of street.

SECOND SCHEDULE.

(To be under the control of and maintained by the One Tree Hill Borough Council.)

ALL that portion of the said Great South Road extending from Cornwall Park Avenue to Waiohua Road, a distance of approximately 102 chains, being coloured blue on the plan hereinafter mentioned, and including the footpath and kerbing on both sides of the said portion of street.

Also the footpath and kerbing on the south-western side of the portion of the said Great South Road extending from Waiohua Road to St. Anne’s Bridge, a distance of approximately 205 chains, such portion of street being coloured green and sienna on the plan hereinafter mentioned.

THIRD SCHEDULE.

(To be under the control of and maintained by the Ellerslie Town Board.)

ALL that portion of the said Great South Road extending from Waiohua Road to Penrose Road, a distance of approximately 103 chains, being coloured green on the plan hereinafter mentioned, and including the footpath and kerbing on the north-eastern side of the said portion of street but not including the footpath and kerbing on the south-western side of such portion of street.

FOURTH SCHEDULE.

(To be under the control of and maintained by the Mount Wellington Road Board.)

ALL that portion of the said Great South Road extending from Penrose Road to St. Anne’s Bridge, a distance of approximately 102 chains, being coloured sienna on the plan hereinafter mentioned, and including the footpath and kerbing on the north-eastern side of the said portion of street but not including the footpath and kerbing on the south-western side of such portion of street.

As the said portions of street are delineated on the plan marked P.W.D. 101874, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured as above mentioned.

FIFTH SCHEDULE.

(Warrants revoked.)

(1) Warrant dated the 25th day of September, 1931, and published in Gazette No. 72 of the 1st day of October, 1931, at page 2889, vesting the control of portions of the Great South Road in the Auckland City Council and the One Tree Hill Borough Council, respectively.

(2) Warrant dated the 26th day of August, 1935, and published in Gazette No. 63 of the 29th day of the same month, at page 2382, varying the Warrant dated the 25th day of September, 1931, immediately hereinbefore referred to.

As witness the hand of His Excellency the Governor-General, this 6th day of March, 1939.

Declaring Land in Canterbury Land District to be subject to the Land for Settlements Act, 1925.

———

GALWAY, Governor-General.

WHEREAS the land described in the Schedule hereto (hereinafter referred to as “ the said land ”) is Crown land not acquired under the Land for Settlements Act, 1925, and is adjacent to certain land acquired under the said Act known as the Lyndon No. 1 Settlement, and can conveniently be disposed of therewith :

Now, therefore, I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, acting in pursuance and exercise of the powers and authorities conferred upon me by section one hundred and five of the said Act, and on the recommendation of the Dominion Land Purchase Board, and after considering the report of the Taranaki District Land Board, do hereby declare the said land to be subject to the said Act to the intent that it shall hereupon be deemed to be portion of the said Lyndon No. 1 Settlement and may be disposed of accordingly.

SCHEDULE.

CANTERBURY LAND DISTRICT.

RESERVE 3554, formerly Section 6A, Lyndon No. 1 Settlement, Block IX, Waiau Survey District, containing by admeasurement 10 acres, more or less.

As witness the hand of His Excellency the Governor-General, this 1st day of March, 1939.
