The Southern and Eastern Sides of Portion of Devon Street, in the City of Wellington, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 1st day of November, 1939.

Present:
THE HON. W. NASH PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Wellington City Council on the nineteenth day of April, one thousand nine hundred and thirty-nine (the portion of street affected by such resolution being more particularly described in the Schedule hereto) viz. :—

“ The Wellington City Council, being the local authority having control of the streets in the City of Wellington, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that part of Devon Street fronting part Lot 20, D.P. 827 ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern and eastern sides of the portion of Devon Street (described in the Schedule hereto) within a distance of thirty-five feet from the centre-line of the said portion of street.

SCHEDULE.

THE southern and eastern sides of all that portion of street, situated in the Wellington Land District, City of Wellington, known as Devon Street, fronting part Lot 20, D.P. 827, being part Section 1, Block XVB, Polhill Gully N.R. As the same is more particularly delineated on the plan marked P.W.D. 104145, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

The South-eastern Side of Portion of Reeves Road, in the City of Christchurch, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Christchurch City Council on the eleventh day of September, one thousand nine hundred and thirty-nine, viz. :—

“ The Christchurch City Council, being the local authority having control of the streets in the City of Christchurch, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of the south-eastern side of Reeves Road, adjoining the land in C.T. 305/248 in the City of Christchurch, being Lot 1, D.P. 4671, part R.S. 157 ” ;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-eastern side of the portion of Reeves Road (described in the Schedule hereto) within a distance of forty-eight feet from the centre-line of the said portion of street.

SCHEDULE.

THE south-eastern side of all that portion of street, situated in the Canterbury Land District, City of Christchurch, known as Reeves Road, fronting Lot 1, D.P. 4671, being part Rural Section 157. As the same is more particularly delineated on the plan marked P.W.D. 105150, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured blue.

Postponing General Election of Members of Christchurch Tramway Board.

ORDER IN COUNCIL.
At the Government Buildings at Wellington, this 1st day of November, 1939.

Present:
THE HON. W. NASH PRESIDING IN COUNCIL.

IN pursuance and exercise of the powers and authorities vested in him by section forty of the Statutes Amendment Act, 1939, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby postpone the holding of the general election of members of the Christchurch Tramway Board ; and doth hereby order and declare that the said general election shall be held and take place on Saturday, the twenty-third day of November, one thousand nine hundred and forty.

Revoking the Declaration of Main Highways and Declaring Public Highways to be Main Highways.

GALWAY, Governor-General.
ORDER IN COUNCIL
At the Government House at Wellington, this 8th day of November, 1939.

Present:
HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers and authorities vested in him by section three of the Main Highways Act, 1922, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby declare that on and after the date of publication of this Order in Council in the Gazette, the portions of main highways described in the First Schedule hereto shall cease to be main highways, and doth further declare that the roads described in the Second Schedule hereto shall be main highways within the meaning and for the purposes of the Main Highways Act, 1922.

FIRST SCHEDULE.

HIGHWAY DISTRICT NO. 1.

Opononi Highway.—All that main highway in Hokianga County, declared as the Opononi Highway, described in Order in Council dated 16th December, 1935, and published in the Gazette on 19th December, 1935.

Waimamaku–Ohaeawai.—All that portion of main highway in Hokianga County commencing at Pakanae and proceeding generally in a south-easterly direction and terminating at a point approximately half a mile south of Waiotemarama Post-office opposite the north-eastern boundary of Waimamaku B 2f 2a Block in Block XIII, Waoku Survey District, being a distance of 6 miles 52 chains, more or less. As the same is more particularly delineated on plan P.W.D. 105276, deposited in the office of the Main Highways Board at Wellington, and thereon coloured yellow.

Kaitaia–Kohukohu via Broadwood.—All that main highway in the Mangonui and Hokianga Counties and the Kaitaia Town District, declared as the Kaitaia–Kohukohu via Broadwood Main Highway, described in Order in Council dated 10th September, 1934, and published in the Gazette on 13th September, 1934.
