sale is for delivery in the districts recognized by the trade as
the Auckland Sugar District or the Southern Sugar District,
respectively, and whether the sale is—
(a) To a consumer—that is to say, a person purchasing
for his own use and not for the purposes of
resale and not being one of the persons described
in any of the following paragraphs of this
regulation ; or
(b) To a retail storekeeper—that is to say, a person
purchasing solely for resale to consumers; or
(c) To a distributor—that is to say, a duly recognized
agent of a sugar manufacturer purchasing for
resale to retail storekeepers, bakers, sugar boilers,
or other process-users of sugar; or
(d) To a manufacturer—that is to say, a person
purchasing under contract from a sugar manu-
facturer, sugar for use in manufacturing processes
in his factory.
5. The maximum prices at which any such sugar as afore-
said may be sold to a consumer for cash over the counter at
places other than those mentioned in the said Schedule shall
be not more than the respective prices set out in the said
Schedule, increased by the amount of any additional freight
and charges incurred in the delivery of the sugar from the
place of purchase to the place of sale.
6. The prices hereinbefore referred to are for a sale for
cash of sugar in packages in accordance with the customary
usage of the trade.
7. Nothing contained in these regulations shall be deemed
to forbid the making or carrying-out of a contract for the sale
of any such sugar as aforesaid at a price exceeding the
respective prices hereinbefore referred to if such sale is made
subject to the condition that if payment of the price is made
by prompt cash in accordance with the customary usage of
trade in the place of delivery the price shall be reduced to the
respective net cash price hereinbefore referred to.
