ORDER IN COUNCIL.

At the Government House at Wellington, this 4th day of October, 1939.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by subsection two of section eighteen of the Public Service Act, 1912, it is enacted that the Commissioner may, whenever it appears advantageous to the Public Service so to do, certify to the Governor-General that it is expedient to add any office to or to abolish any office from the Administrative Division of the Public Service of New Zealand; and the Governor-General in Council may, upon such certificate, add any office to the Administrative Division or abolish any office therein:

And whereas the Public Service Commissioner has certified to the Governor-General that it is expedient to add the office of Deputy Commissioner of Taxes, Land and Income Tax Department, to the said Administrative Division:

Now therefore His Excellency the Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred on him by the said section and of all other powers enabling him in this behalf, and acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby add the office of Deputy Commissioner of Taxes, Land and Income Tax Department, to the said Administrative Division.

Setting apart Native Land as a Native Reservation.

GALWAY, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this 4th day of October, 1939.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

PURSUANT to section five of the Native Purposes Act, 1937, His Excellency the Governor-General, acting by and with the advice and consent of the Executive Council, doth hereby set apart and reserve the Native freehold land described in the Schedule hereto as a Native Reservation for the common use, as a papakāinga, of the members of the tribe known as Waikato of which the late Kingi te Rata Mahuta Tawhiao Potatau te Wherowhero was Chief and of all Natives, including homeless Natives, who shall fully acknowledge his chieftainship or that of his successors.

Portions of Roads in the County of Waikouaiti exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

GALWAY, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this 11th day of October, 1939.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waikouaiti County Council on the thirtieth day of June, one thousand nine hundred and thirty-nine (the portions of roads affected by such resolution being more particularly described, and shown edged red on the plan referred to in the Schedule hereto), viz.:—

“ That the Waikouaiti County Council, being the local authority having control of the roads in the Waikouaiti County, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the portions of the said roads in the Waikouaiti County fronting Sections 9A, 10, and part 11, and Section 1438n, Block XII, Town of Waikouaiti; the said portions of the roads are more particularly shown on the plan annexed hereto ”;

subject to the condition that no building or part of building shall at any time be erected on the land fronting the portions of roads (described in the Schedule hereto) within a distance of thirty-three feet from the centre-lines of the said roads.


SCHEDULE.

All those portions of Bernera Street, Duncansby Street, Eris Street, and an unnamed road, situated in the Otago Land District, County of Waikouaiti, fronting Sections 9A, 10, 11 and 1438n, Block XII, Town of Waikouaiti. As the same are more particularly delineated on the plan marked P.W.D. 109858, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.

The South-western Side of Portion of Brockville Road in the City of Dunedin, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

GALWAY, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this 11th day of October, 1939.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Dunedin City Council on the third day of July, one thousand nine hundred and thirty-nine, viz.:—

“ That the Dunedin City Council, being the local authority having control of the streets in the City of Dunedin, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-western side of portion of Brockville Road abutting on parts Sections 2 and 686a, Lower Kaikorai District ”;

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the south-western side of the portion of Brockville Road (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.


SCHEDULE.

The south-western side of all that portion of street, situated in the Otago Land District, City of Dunedin, known as Brockville Road, fronting parts Sections 2 and 686a, Lower Kaikorai District. As the same is more particularly delineated on the plan marked P.W.D. 103845, deposited in the office of the Minister of Public Works at Wellington, and thereon edged red.
