Portions of Roads in the County of Waimea exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

At the Government House at Wellington, this 19th day of October, 1938.

Present:

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Waimea County Council on the ninth day of September, one thousand nine hundred and thirty-eight, viz.:—

"That the Waimea County Council, being the local authority having control of the roads within the Waimea County, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the following roads, namely:—

"(a) The southern and western sides of the roads fronting the northern and eastern boundaries of part Section 23, Block XI, Motueka Survey District, as shown on plan prepared by F. A. C. Staig, Registered Surveyor, and coloured red thereon. (E. M. Green);

"(b) The eastern, southern, and western sides of the roads fronting the western, northern, and eastern boundaries of part Section 15, Motueka Original, Block III, Motueka Survey District, as shown on plan prepared by F. A. C. Staig, Registered Surveyor, and coloured red thereon. (Estate late F. Fry)";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the said portions of roads (described in the Schedule hereto), within a distance of thirty-five feet from the centre-lines of the said portions of roads.

SCHEDULE.

ALL those portions of roads in the Nelson Land District, County of Waimea, fronting part Section 15, Motueka Original, Block III, Motueka Survey District, shown A-B, C-D, E-F on plan marked P.W.D. 100743.

Also all those portions of roads in the said land district and county fronting part Section 23, Block XI, Motueka Survey District, shown A-B, B-C, and C-D on plan marked P.W.D. 100744.

As the same are more particularly delineated on the plans marked as above mentioned, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured red.

Portion of White Street, in the Borough of Blenheim, exempted from the Provisions of Section 128 of the Public Works Act, 1928, subject to a Condition as to the Building-line.

IN pursuance and exercise of the powers conferred by the Public Works Act, 1928, and of all other powers in anywise enabling him in this behalf, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby approve of the following resolution passed by the Blenheim Borough Council on the twenty-third day of June, one thousand nine hundred and thirty-eight, the portion of street affected by such resolution being more particularly described in the Schedule hereto, viz.:—

"The Blenheim Borough Council, being the local authority having control of White Street, by resolution declares that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to that portion of such street adjoining Lots 11 and 12 of Section 6, Omaka, Deposited Plan 106, 10898 links in length as shown on plan, and being the land contained in Certificate of Title, Volume 4, folio 176";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the southern side of portion of White Street (described in the Schedule hereto) within a distance of thirty-three feet from the centre-line of the said portion of street.

SCHEDULE.

THE southern side of all that portion of street, situated in the Marlborough Land District, Borough of Blenheim, known as White Street, fronting Lots 11 and 12, D.P. 106, being parts of Sections 4 and 6, Omaka District. As the same is more particularly delineated on the plan marked P.W.D. 100160, deposited in the office of the Minister of Public Works at Wellington, and thereon coloured brown.

(1) "The Main Highways Board, being the local authority having control of the Nelson-Westport Main Highway, hereby declares this 22nd day of September, 1938, that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the south-eastern side of that portion of the said highway fronting part Section 74, Waimea South, Block IX, Waimea Survey District, as shown marked A-B on P.W.D. 100501;

(2) "The Main Highways Board, being the local authority having control of the Nelson-Westport Main Highway, hereby declares this 22nd day of September, 1938, that the provisions of section one hundred and twenty-eight of the Public Works Act, 1928, shall not apply to the north-western side of portion of the said highway fronting part Section 130, Waimea East, Block VI, Waimea Survey District, as shown marked E-F on P.W.D. 100502";

subject to the condition that no building or part of a building shall at any time be erected on the land fronting the portions of the Nelson-Westport Main Highway (described in the Schedule hereto), within a distance of thirty-three feet from the centre-lines of the said portions of roads.

THE south-eastern side of all that portion of road in the Nelson Land District, County of Waimea, known as the Nelson-Westport Main Highway, fronting part Section 74, Waimea South, Block IX, Waimea Survey District, shown A-B on plan marked P.W.D. 100501.

Also the north-western side of all that portion of the said road in the land district and county fronting part Section 130, Waimea East, Block VI, Waimea Survey District, shown E-F on plan marked P.W.D. 100502.
