SOUTHLAND LAND DISTRICT.—FIRST-CLASS RURAL LAND.
Southland County.—Town of Mataura Bridge.
SECTIONS 39 to 41, Block XVII: Area, 13 acres 1 rood 24 perches. Upset price, £500.
Situated on the eastern boundary of the Town of Mataura Bridge about one mile from Mataura Post-office. The road giving access to this area is steep. These three sections adjoin and are all in one paddock, the southern half being practically level, thence sloping slightly to the north. All in good pasture.

Timber in Otago Land District for Sale by Public Auction.
District Lands and Survey Office,
Dunedin, 20th September, 1938.
NOTICE is hereby given that the right to cut and remove the milling-timber on the undermentioned land will be offered for sale by public auction at the District Lands and Survey Office, Dunedin, at 11 o’clock a.m. on Thursday, 27th October, 1938, in accordance with the provisions of the Land Act, 1924, and the timber regulations thereunder.
SCHEDULE.
PART Section 36s, Clifton Settlement: Area, 15 acres, approximately.
Estimated quantity of timber:—
P. Radiata .. 362,264 ft. board measurement.
P. Muricata .. 2,525 ft. ,,

Total .. 364,789 ft. ,,
The plantation is situated on the above section approximately six miles and a half from Waiwera Railway-station, of which six miles is metalled road and the balance clay road.
Upset price: £430.
Time for removal of timber: Two years.
Terms of Payment.
A marked cheque for the amount of the bid in excess of £300, together with £1 1s. license fee, must be paid on the fall of the hammer, and the balance will be payable by three equal instalments, the first within six months, the second within twelve months, and the third within eighteen months thereafter.
All instalment-payments shall bear interest at the rate of five per centum per annum as from the date of sale, and with interest added shall be secured by “on demand” promissory notes endorsed by two approved sureties, and such bills are to be completed and lodged with the Commissioner of Crown Lands within fourteen days after the purchaser has been notified to complete.
Conditions of Sale.

The right to cut and remove the timber will be sold in accordance with the provisions of the Land Act, 1924, the regulations in force thereunder, and these conditions, and such additional conditions as the Commissioner of Crown Lands considers necessary in the interests of the Crown or of the public.

The quantities set forth in the above Schedule are approximate only, and are furnished for the information of intending purchasers, who are expected to make their own estimate. No contract for purchase shall be voidable, nor shall the licensee be entitled to any abatement in price by reason of the said timber being of less quantity and kind than as stated herein, nor shall any extra sum be claimed by the Crown if the quantity of timber is found to be in excess of that stated herein.

The promissory notes will be presented at intervals as indicated in terms of payment, but they may be presented for payment at earlier dates if more than a due proportion of the timber is found to have been cut, or should any breach of the conditions have occurred, or if, in the opinion of the Commissioner, the interest of the Crown has been jeopardized.

The purchaser of the timber shall have no right to the use of the land.

The purchaser shall have the right to cut and remove only such trees as can be milled, and shall have no right to any trees which would be suitable only for posts or firewood.

The licensee shall have the right to construct and use such tramways as may be found necessary for the proper cutting, milling, and removal of the timber.

If at any time during the currency of the license a Field Inspector or other person duly authorized by the Commissioner of Crown Lands shall report, or it otherwise appears that the timber on the said areas is being improperly cut, or that the interests of the Crown are being prejudiced, the Commissioner of Crown Lands may, by notice in writing to the licensee and his sureties, suspend the license, pending investigation, and the Commissioner may cancel such license if it is found that its conditions have been infringed, without prejudice to any proceedings for damage done, recovery of amount due for royalties, or otherwise.

If the timber is not sold at auction, the right to purchase same at the upset price will remain open for application until further notice.

No compensation will be given nor shall any be claimed for any error, discrepancy, or misdescription whatever in respect of the Schedule or the conditions herein described.

All timber, whether standing or felled or in logs, shall remain the property of the Crown until all instalments shall have been paid.

Should any dispute arise as to boundaries, the decision of the Commissioner of Crown Lands shall be final and conclusive.

The timber will be sold generally in accordance with the areas and boundaries as shown on the sale maps, which may be seen at the District Lands and Survey Office, Dunedin.

The licensee shall not allow any sawdust to find its way into any watercourse of any description.

The highest or any bid will not necessarily be accepted.

The area must be left clear of refuse on termination of operations.

STATE FOREST SERVICE NOTICE.
Milling-timber for Sale by Public Tender.
State Forest Service,
Nelson, 21st September, 1938.
NOTICE is hereby given that written tenders for the purchase of the undermentioned milling-timber will close at the office of the State Forest Service, Nelson, at noon on Friday, the 14th day of October, 1938.
SCHEDULE.
NELSON-MARLBOROUGH FOREST-CONSERVATION REGION.—NELSON LAND DISTRICT.
ALL the milling-timber on that piece of land containing 69 acres, in Block XVI, Orikaka Survey District, Provisional State Forest No. 50, situated about five miles from Lyell by road.
The total estimated quantity of timber in cubic feet is 103,903, or in board feet 669,800, made up as follows:—

Terms of Payment.
A marked cheque for one-fifth of the sum tendered, together with £1 1s. license fee, must accompany the tender, and the balance be paid in five equal two-monthly instalments commencing two months from the date of sale.
Terms and Conditions.
- All instalment-payments shall be secured by “on demand” promissory notes made and endorsed to the satisfaction of the Commissioner of State Forests, and interest at the rate of 1 per cent. per annum in excess of current bank overdraft rates will be charged on all notes overdue from the date of maturity to the date of payment.
