The Shops and Offices Act, 1921-22.—Prohibiting the Sale
within the Borough of Te Kuiti of certain Goods comprised
in the Trade of a Fruiterer.

WHEREAS a petition in writing, signed by a majority
of the occupiers of all the fruiterers’ shops within
the Borough of Te Kuiti, has been forwarded to me desiring
that the sale of certain goods comprised in the trade of a
fruiterer—namely, fresh and preserved fruit (other than
jam)—be prohibited during such time as the said shops
are required to be closed in pursuance of the Shops and
Offices Act, 1921-22 :

And whereas I am satisfied that the sale of the said goods
is comprised in the said trade within the said borough, and
that the signatures to such petition represent a majority of
the occupiers of all the said shops within the said borough :

Now, therefore, in pursuance of section 33 of the said Act,
I, Hubert Thomas Armstrong, Minister of Labour, do hereby
direct that on and after the 1st day of August, 1938, the
sale of the said goods within the said borough shall be and
is hereby prohibited as follows: During the period from the
1st day of May to the 30th day of September (both days
inclusive) on Mondays, Tuesdays, Wednesdays, and Thursdays
after the hour of 8 p.m., and on Fridays and Saturdays
after the hour of 11.30 p.m.

Assenting to an Agreement for Grant of Right-of-way in favour
of Ailsey Jacobs, Wife of Sydney Jacobs, of London, Merchant,
over Land in Motueka Survey District, taken for the Purposes
of Buildings of the General Government.

WHEREAS by a Proclamation dated the 30th day of
April, 1938, and published in the New Zealand
Gazette No. 34 of the 5th day of May, 1938, all that piece of
land containing 2 acres 0 roods 12-98 perches, being portion
of Section 153, Motueka Original, Block IV, Motueka Survey
District (Borough of Motueka), was taken for the purposes of
buildings of the General Government :

And whereas Ailsey Jacobs, wife of Sydney Jacobs, of
London, Merchant, was entitled to compensation for her
freehold interest in the said area of 2 acres 0 roods 12-98
perches :

And whereas the Minister of Public Works agreed to
grant to the said Ailsey Jacobs a right-of-way over an area of
17-9 perches, being portion of the area aforesaid and shown
coloured yellow on plan P.W.D. 98893 referred to in the said
Proclamation as part satisfaction of the compensation afore-
said, and to provide a sum of money in satisfaction of the
residue of the said compensation :

And whereas the said Ailsey Jacobs agreed to accept
such grant and sum of money in satisfaction of the said
compensation :

Now, therefore, I, Robert Semple, Minister of Public
Works, do hereby give notice, in pursuance of section 97 of
the Public Works Act, 1928, that I assent to the above
agreement.

Classification of Roads in Inangahua County.

IN pursuance and exercise of the powers conferred on
him by the Transport Department Act, 1929, and the
Heavy Motor-vehicle Regulations, 1932, the Minister of
Transport does hereby revoke that portion of the Warrant
dated the 31st day of March, 1930, and published in the
New Zealand Gazette No. 25 of the 3rd day of April, 1930,
at page 1001, in so far as it relates to the classification of
the road described in the Schedule hereto, and does hereby
declare that the road described in the Schedule hereto and
situated in the Inangahua County shall belong to the class
of road shown in the said Schedule.

SCHEDULE.

INANGAHUA COUNTY.

Road classified in Class three: Available for the use thereon
of any heavy motor vehicle (other than a multi-axled heavy
motor-vehicle) which with the load it is carrying weighs not
more than 7 tons, or any multi-axled heavy motor-vehicle
which when carrying a load has an axle weight of not more
than 4½ tons on any one axle :—

Gannon Road.

Excluding Streets and Roads from Limitation as to Speed
imposed by the Motor-vehicles Amendment Act, 1936,
Section 3.

IN terms of section 3 of the Motor-vehicles Amendment
Act, 1936, the Minister of Transport does hereby
exclude the streets and roads described in the Schedule
hereto from the limitation as to speed imposed by the said
section.

SCHEDULE.

SITUATED within Leamington Town District—
Any road or other place to which the public have access
within Leamington Town District.

Situatcd within Huntcrville Town District—
Te Kuiti : Bulls via Taumarunui Main Highway No. 23
(all that portion commencing at its junction with Station
Road and terminating at the northern boundary of
Huntcrville Town District, as now constituted, a distance
of approximately 25 chains).

Ongo Main Highway No. 432 (all that portion commencing
at its junction with Potaka Road and terminating at
the western boundary of Huntcrville Town District, as
now constituted, a distance of approximately 32 chains).

Rangatira Road (all that portion commencing at a point
16 chains measured along the road in an easterly direction
from the Government railway-crossing and terminating
at the eastern boundary of Huntcrville Town District,
as now constituted, a distance of approximately 30 chains).

Election of Member of Hawke’s Bay Land Board.

District Lands and Survey Office,

I, FRANK RUPERT BURNLEY, Returning Officer for
the election of a member of the Hawke’s Bay Land
Board, do hereby notify, in accordance with the provisions
of section 47 of the Land Act, 1924, and the regulations made
thereunder, that the only person nominated to fill the vacancy
occurring on the said Board was Cornelius John O’Reilly,
Esquire, of Porangahau. I do therefore hereby declare that
the said Cornelius John O’Reilly is duly elected a member
of the Hawke’s Bay Land Board for a term of two years as
from the 28th day of August, 1938.
