Crown Land set apart for the Purposes of Part I of the Housing Act, 1919.

A PROCLAMATION.

IN pursuance of the power and authority conferred upon me by section nine of the Housing Act, 1919, I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, do hereby proclaim and declare that the area of Crown land described in the Schedule hereto shall be and the same is hereby set apart for the purposes of Part I of the said Act.

BOROUGH OF OHAKUNE.

SECTIONS 1 to 14, Block VII, Town of Ohakune Extension No. 1, Block VIII, Makotuku Survey District : Area, 3 acres 2 roods 28 perches, more or less. (S.O. plan 170/37.)

IN pursuance and exercise of the powers conferred by section twelve of the Land Act, 1924, I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, do hereby proclaim as road the land described in the First Schedule hereto; and also do hereby proclaim as closed the road described in the Second Schedule hereto.

Authorizing George Bruce Nichol, of Clarks, Outram, Farmer, to use Water for the Purpose of generating Electricity.

ORDER IN COUNCIL.

At the Government Buildings at Wellington, this 13th day of July, 1938.

Present :

THE RIGHT HON. M. J. SAVAGE PRESIDING IN COUNCIL.

PURSUANT to the Public Works Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby grant to George Bruce Nichol, of Clarks, Outram, Farmer (hereinafter referred to as “the licensee”), a license subject to the conditions hereinafter set forth to obstruct, impound, or divert the waters of an unnamed stream situated in Section 1B, Block 6, Lee Stream Survey District, in the Land District of Otago, and to take and use therefrom for the purposes hereinafter set forth a stream of water not exceeding one-quarter of a cubic foot per second at any one time.

CONDITIONS.

  1. IMPLIED CONDITIONS.

THE conditions directed to be implied in all licenses by the Water-power Regulations, 1934, and the Electrical Supply Regulations, 1935, shall be incorporated in and shall form part of this license except in so far as the same may be inconsistent with the provisions hereof.

  1. LICENSE SUBJECT TO REGULATIONS.

This license is issued under the Water-power Regulations, 1934, the Electrical Supply Regulations, 1935, and is subject thereto and to any regulations made or to be made in amplification or amendment thereof or in substitution therefor.

  1. UTILIZATION OF WATER AND LOCATION OF HEADWORKS.

Water shall be used under this license solely for the purpose of generating electricity up to a maximum capacity of 1 kilo-watt at 240 volts direct current, and shall be taken from the stream at the point in Section 1B, Block 6, Lee Stream Survey District, indicated on the plan marked P.W.D. 98894, deposited in the office of the Minister of Public Works.

  1. GENERAL DESCRIPTION OF WORKS.

The licensee is hereby authorized, subject to the conditions hereof, to construct, maintain, and use the following works for the purposes of this license, all in the Lee Stream Survey District, the positions of the said works being indicated on the said plan P.W.D. 98894:-

(a) Headworks consisting of an intake, dam, and water-race traversing Section 3c, Block 6, and Section 4, Block I, and pipe-lines leading to the water-wheel and power-house situated in said Section 4, Block I, Lee Stream Survey District, and hereinafter referred to, giving a static head of approximately 150 ft.
(b) A power-house with all necessary equipment for generating electricity.
(c) Tail-race leading from the power-house to the said stream.

  1. SYSTEM OF SUPPLY.

The system of supply shall be as described in paragraph (d) of clause 21-01 of the Electrical Supply Regulations, 1935. The generating voltage and the transmission voltage shall be approximately 240 volts direct current.

  1. DURATION OF LICENSE.

Unless sooner determined, this license shall continue in force until the 31st day of March, 1959, or until electrical energy is available from an Electric-power Board, or other general public source, whichever is the earlier.

  1. RENTAL.

For the purpose of assessing the annual rental payable in respect of this license, the licensee may install a suitable maximum-demand indicator to the satisfaction of the Inspecting Engineer of the Public Works Department, and, failing such installation, the rental shall be assessed on the maximum generating capacity of the plant installed. The present plant is rated at 1 kilowatt, and falls within the class described in paragraph (c) of subclause (B) of clause (1) of Regulation 6 of the Water-power Regulations, 1934.
