Amending an Order in Council cancelling the Reservation over a Reserve in Mokihinui Survey District, Nelson Land District.

ORDER IN COUNCIL.

At the Government House at Wellington, this 20th day of January, 1938.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

WHEREAS by an Order in Council dated the thirtieth day of June, one thousand nine hundred and thirty-seven, and published in the Gazette of the eighth day of July of that year, the reservation for ferry purposes over a reserve in the Nelson Land District was cancelled in terms of subsection one (b) of section seven of the Public Reserves, Domains, and National Parks Act, 1928 :

And whereas an error was made in the description of the land in the Schedule to the said Order in Council, and it is expedient that the error should be rectified :

Now, therefore, I, George Vere Arundell, Viscount Galway, Governor-General of the Dominion of New Zealand, in pursuance and exercise of the powers conferred upon me by the Public Reserves, Domains, and National Parks Act, 1928, and of every other power and authority enabling me in this behalf, do hereby amend the said Order in Council by substituting the description of the land set forth in the Schedule hereto for the description of the land set forth in the Schedule to the said Order in Council.


SCHEDULE.

NELSON LAND DISTRICT.

SECTIONS 1 and 2, Square 144, Block XI, Mokihinui Survey District : Area 84 acres 2 roods 13 perches, more or less.

Cancelling the Reservation over Part of a Reserve in Bealey Survey District, Canterbury Land District.


GALWAY, Governor-General.

ORDER IN COUNCIL.

At the Government House at Wellington, this 20th day of January, 1938.

Present :

HIS EXCELLENCY THE GOVERNOR-GENERAL IN COUNCIL.

IN pursuance and exercise of the powers and authorities conferred upon him by subsection one (b) of section seven of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby cancel the reservation for Provincial Government and other public purposes over the land described in the Schedule hereto ; and doth hereby declare that the said land, being vested in the Crown, is Crown land available for disposal under the Land Act, 1924.


SCHEDULE.

CANTERBURY LAND DISTRICT.

ALL that area containing by admeasurement 1 acre 3 roods 21 perches, more or less, being part Reserve 394, situated in Block XIV, Bealey Survey District, and bounded as follows : Commencing at a point on the south-western side of the West Coast Road, 500·2 links from the intersection of the eastern boundary of Reserve 2461 and the said south-western side of the West Coast Road ; thence south-easterly along that road, 600·2 links ; thence south-westerly at a right angle, 190·8 links, to the northern boundary of Reserve 3286 ; thence easterly along the boundary of that reserve, 654·6 links ; and thence north-easterly, 436·5 links, to the point of commencement. As the same is more particularly delineated on the plan marked L. and S. 6/3/269A, deposited in the Head Office, Department of Lands and Survey, at Wellington, and thereon bordered red.

IN pursuance and exercise of the powers conferred by section forty-four of the Public Reserves, Domains, and National Parks Act, 1928, His Excellency the Governor-General of the Dominion of New Zealand, acting by and with the advice and consent of the Executive Council of the said Dominion, doth hereby appoint

The Chairman of the Helensville Town Board, ex officio,

The member of the Waitemata County Council representing the Kumeu Riding, ex officio,

Colin Campbell,

William Gordon Coster,

Eric Sydney Gittos,

John Harold Houghton,

Thomas Francis Moore, and

Harry Bayley Stevens

to be the Motutara Domain Board, having control of the land described in the Schedule hereto ; and doth hereby appoint Thursday, the twentieth day of January, one thousand nine hundred and thirty-eight, at one o’clock p.m., as the time when, and the Secretary’s Residence, Beach Road, Muriwai Beach, as the place where, the first meeting of the Board shall be held.

ALL that area containing by admeasurement 53 acres 2 roods 26 perches, more or less, being Section North 2 of Block IX, Kumeu Survey District, and parts of Motutara Native Block : Bounded, commencing at the intersection of the south-eastern boundary of a public road, shown on deposited plan No. 7794, with the north-eastern boundary of Motutara Block ; on the south-east generally by another portion of the Motutara Block, 236·1 links, bearing 197° 42′ ; 427·5 links, bearing 218° 11′ ; 565·5 links, bearing 222° 53′ ; 326 links, bearing 248° 50′ ; 421·2 links, bearing 218° 32′ ; 219·5 links, bearing 265° 4′ ; 241·3 links, bearing 275° 27′ ; 94·3 links, bearing 250° 10′ ; 528·8 links, bearing 243° 7′ ; 124·6 links, bearing 193° 13′ ; 299·2 links, bearing 240° 20′ ; 161·1 links, bearing 204° 44′ ; and 149·9 links, bearing 268° 11′, to a foreshore reserve 1 chain wide ; thence on the west by that foreshore reserve to the south-western boundary of part of Allotment 37 of the western portion of Taupaki Block ; thence on the north-east by the said part of Allotment 37, by Lot 1, shown on deposited plan No. 9548, by another part of the said Allotment 37, and by the abuttal of a public road, to the place of commencement.
